ExECUTIVE SUMMARY The'Compensation Plan for` Unit 8' Department Heads reflect the benefit adjustment recommend by the City Manager (see Attachment A): 2`. BACKGROUND The City Manager recom in, ends, the same.'benefit adjustmentbe extended to the Department Heads as was extended to other employee bargaining whits which consists rof the ,increase in the monthly health insurance premiiini tliatwi °ll, -be paid on behalf of the and increasing the "cash back" provisions that,provides a cash in-- lieu..of'the benefit which'is 50 % of 'the City's cost to provide the health insurance. 3. ALTERNATIVES Not adopt resolution and employ_ ees would.rece'ive no benefit adjustment for the period July 1, 2004 through June 30, 2005. 1 FINANCIAL IMPACTS The total cost to the City has been estimates to be $'8 5. CONCLUSION This proposal provides only -yforthe .increase in the _health insurance,prem um.for the employee. The cost of living increase, if any, is ,at the discretion of the City Manager :based on the performance of the individual Department Head. Implementation of the increased health'insurance benefit. 7. RECOMMENDATION Approval of the Resolution and, authorization for the City Manager to amend the Compensation Plan with the changes described m the attached document. The City ;shall provide for a long -term disability plan, with the ,premium to he paid for by the City. SECTION ;15 MEDICAL %DENTAL CASH BACK ' An eligible employee may request- cancellation of'the employee's City paid medical and/or dental insurance coverage. Once the employee provide§ adequate proof that lie /she has medical and /or dental coverage from another source, it will be processed under the terms and conditions and cancellation requirements of their particular plan. The City will 'p'rocess :the cancellation, effective-the first day of the month following the effective date cancellation. The cash back is based on; what the employee's coverage level would have normally been (i.e., employee, employee + one dependent, employee + .family) at the time of such "cancellation.. However, if the employee's current health premium amount pis less than the medical premium amount listed bel'ow,'the City will use the lower rate to calculate the cash back amount. The cash back "amount is ,paid once a month and'is included''in the. employee's paycheck. Hours that are banked under" Section "Vacation, Payment of" may be used upon submittal of a memo to the Human Resources Office for Vacation purposes.. These hours' shall. be deducted from the existing bank. •. 16.4 Vacation.Adjustment Employees who are granted time off for scheduled holidays shall not have such holidays' charged as vacation leave When the vacation leave and holiday(s) coincide. 16.5 Accrual Limits Vacation accruals shall be capped:at;three (3) times the! amount listed in section 17:1, Accrual. SECTION 1 SICK;LEAVE 17.1-. General Sick'leave, with, pay. shall be granted to all employees as set forth in this section.. Sick leave i&not a, right,, which an employee may -use at his .discretion, but rather, shall he used, only in cases of personal illness, disability or the serious illness or injury of an employee's family member, which requires .:the employee's attention. The 'term family member shall include: spouse, children, parents, spouse's' parents, brothers,, sisters, or other individuals whose relationship . to the employee isthat° of a, dependent or near dependent. 17.2 Accrual Sick leave shall accrue to all full =time employees at the rate of eight (8) hours for each month of. • continuous service,. No employee shall accumulate more sick, leave in any year than provided. 17.3 Relationship 'To Workers' Compensation Benefits shall be payable in situations .where miscellaneous employee's: absence is due to industrial injury as provided in.. California 'State Workers' Compensation Law. During the first three (3) Workdays when the employee's absence from work has been occasioned by . injury suffered `during his/her employment and he /she .receives Workers' Compensation, he �she shall receive full pay. Following this period, 'sick leave may be a supplement to. the Workers' Compensation benefits provided the employee. Compensation is at his/her regular rate fora period not to. exceed six (6) irfonths,, or until sick leave is exhausted; or the disability is abrogated, or 'that employee` is `certified "permanent and stationary'' by a. competent :medical authority.. The City shall, pay him/her the regular salary, based on the combination 'of the Workers' Compensation benefit plus. sick leave. If possible, employees must provide thirty (3'0) days advanc&notice of leave. SECTION 20 - PREGNANCY DISABILITY. LEAVE The City will provide pregnancy disability leave for eligible employees''as- required ;liy City policy and state law; and as specifically provided in the Fair Employment - and Housing Act, and "the California Family Rights Act 'of 1993. If possible employees must provide thirty (30,)' days advance notice of leave. SECTION 21 VICTIMS OF DOMESTIC VIOLENCE California Labor Code; 230 and -230A allows use of such leave for Victims of Domestic Violence for any of the following: to se& medical attention for related injuries; to obtain services from a dorndstid. violence shelter, °program Or rape crisis center;, to obtain psychological ,couiiseling; or to participate in safety planning. Certification of need. may be required in the form' of a police: report, protection order--; documentation from court or from a inedical professional domestic violence advocate, or °counselor.
