1. ExECUTIVE SUMMARY
The'Compensation Plan for` Unit 8' Department Heads reflect the benefit adjustment recommend by the
City Manager (see Attachment A):
2`. BACKGROUND
The City Manager recom in, ends, the same.'benefit adjustmentbe extended to the Department Heads as
was extended to other employee bargaining whits which consists rof the ,increase in the monthly health
insurance premiiini tliatwi °ll, -be paid on behalf of the and increasing the "cash back"
provisions that,provides a cash in-- lieu..of'the benefit which'is 50 % of 'the City's cost to provide the
health insurance.
3. ALTERNATIVES
Not adopt resolution and employ_ ees would.rece'ive no benefit adjustment for the period July 1, 2004
through June 30, 2005. 1
FINANCIAL IMPACTS
The total cost to the City has been estimates to be $'8
5. CONCLUSION
This proposal provides only -yforthe .increase in the _health insurance,prem um.for the employee. The cost
of living increase, if any, is ,at the discretion of the City Manager :based on the performance of the
individual Department Head.

Approval of the Resolution and, authorization for the City Manager to amend the Compensation Plan
with the changes described m the attached document.

WHEREAS, the employees n Unit 8. are not represented by any recognized employee
organization; and,
WHEREAS, the City Manager,, pursuant to S "ection 28; City of Petaluma City Charter, is
required and empowered to make a recommendation to the City Council on matters related to
employees' compensation; and,
WHEREAS, the City 'Manager has recommended that benefit adjustments for the
employees in Unit 8 (Department.Heads) Compensation Plan be amended.
NOW, THEREFORE, BE IT RESOLVED that the amended benefits as specified in
the attachment A for employees iri this 'Unit, be' approved and shall be effective July 1, 2004
through June 30, 2005.

BEREAVEMENT. LEAVE

r . An employee shall be granted up to thirty two (32) _ bereavement leave in the event 'of
death in the employee's immediate family. For' the purpose of bereavement leave, immediate
family shall mean spouse, qualified domestic partner, father, father -in -law, mother ,mother -in-
law, brother, brother -in -law sister, sister - in-law, child. (including stepchildren), stepparents,
grandparents and ,grandchildren- ` or arson p With w hom the employee has a relationship in loco
parentis. Up to an additional eight (8) hours of accrued sick leave may be granted to supplement
bereavement leave.
In the event an employee .must travel more than 3,00 miles to. -attend a funeral or memorial
service, an additional eight' (8) Hours of bereavement leave shall be granted instead of the use of
eight (8) hours of sick leave.
FAMILY MEDICAL LEAVE ACT
The City inserts the following revised language to update the'pol'icy statement.
The City will provide family and medical care leave for eligible employees as required by City
policy, state and federal .law an&as' specifically provided in the Federal Family and Medical
Leave Act of 1993 '(FMLA) and the California Family Rights Act of 1993 (CRFA). If possible,
employees must provide thirty (30) days advance notice of leave.
' PREGNANCY DISABILITY
The City inserts the following revised 'language to update the policy statement.
The City will provide pregnancy disability leave: for eligible, 'empl'oyees as required by City
policy and state law and as• .specifically provided in the Fair Employment and Housing Act and
the California Family Rights Act of 1993. If possible, employees must provide thirty (30) days
advance notice of leave.

SECTION 1- - TERM OF PLAN
This Compsation Plan shall be:•for a one, (I) year term for th&Tiscal Year commencing July 1,
2004 through June 3.0 2005.

SECTION 8 - WORK DURING LOCAL EMERGENCY
Employees L who are required to work when called, to an activated: Emergency Operation Center
local emergency shall be paid at their fegularliourly rate for all hours" beyond their - normal
Workday.
SECTION 9 - UNIFORM ALLOWANCE
The classifications of Police, Chief land Rre, - Cluef -shall. receive $300.00-per year as a Uniform
Allowance. This, -amount shall be paid in Decemb6r.
SECTION 10 - RETIREE BENEFIT'PAYMENTS
Retired Employees:
An employee with h . twehty (20) -years of service and who is age , fifty `(50,) or older and who retires
on a service xet . irement during the term of this ageenie

beginning on the retirement date. The payment will decrease in the amount per year to

For employees retiring after September 1, 1997 and who meet the service. requirements listed in
paragraph one (1) above employees'shall receive an additional $20:00 per month as a
retiree service benefit. Should the retired employee not continue in the PEMCHA plan, that
retired employee will be eligible.,for' an amount of $120.00 as a direct payment as a retiree service
benefit. It is the responsibility of the retiree'to notify the City in writing that he /she is not being
covered by the PEMCHA plan land the City will commence payment of the $120.00 at the

SECTION ;11 - MEDICAL /DE " L INSURANCE

SECTION 12 • . VISION, INSURANCE

$25.00 deductible: Frames are available every, twelve (12) months with , a maximum benefit of
$120.00 and lenses are available' °everytwelve (1'2) inonths'with a maximum benefit of $200.00.

SECTION 14 - -LONG TERM DIS INSURANCE.
The City ;shall provide for a long -term disability plan, with the ,premium to he paid for by the
City.
SECTION ;15 MEDICAL %DENTAL CASH BACK '
An eligible employee may request- cancellation of'the employee's City paid medical and/or dental
insurance coverage. Once the employee provide§ adequate proof that lie /she has medical and /or
dental coverage from another source, it will be processed under the terms and conditions and
cancellation requirements of their particular plan. The City will 'p'rocess :the cancellation,
effective-the first day of the month following the effective date cancellation.
The cash back is based on; what the employee's coverage level would have normally been (i.e.,
employee, employee + one dependent, employee + .family) at the time of such "cancellation..
However, if the employee's current health premium amount pis less than the medical premium
amount listed bel'ow,'the City will use the lower rate to calculate the cash back amount. The cash
back "amount is ,paid once a month and'is included''in the. employee's paycheck. The following are
the rates used to determine medical cash back:

Upon declining medical and/or dental insurance, the .employee will be required to meet the terms

dental plan, then he /she must meet the current terms and conditions of the City's medical, and /or
dental plan: ' The „City cannot; guarantee that once the employee leave& a particular medical, and/or
dental plan, he /she in ,bei able to re - enroll in their prior plan and under the sanie terms and
conditions of their prior plan.

16.1 Accural

equivalent of eighty (80) hours of -vacation with, pay in - the , year following the year in which
vacation is earned.

16.3 Banked Hours.
Hours that are banked under" Section "Vacation, Payment of" may be used upon submittal of a
memo to the Human Resources Office for Vacation purposes.. These hours' shall. be deducted
from the existing bank. •.
16.4 Vacation.Adjustment
Employees who are granted time off for scheduled holidays shall not have such holidays' charged
as vacation leave When the vacation leave and holiday(s) coincide.
16.5 Accrual Limits
Vacation accruals shall be capped:at;three (3) times the! amount listed in section 17:1, Accrual.
SECTION 1 SICK;LEAVE
17.1-. General
Sick'leave, with, pay. shall be granted to all employees as set forth in this section.. Sick leave i¬
a, right,, which an employee may -use at his .discretion, but rather, shall he used, only in cases of
personal illness, disability or the serious illness or injury of an employee's family member, which
requires .:the employee's attention. The 'term family member shall include: spouse, children,
parents, spouse's' parents, brothers,, sisters, or other individuals whose relationship . to the
employee isthat° of a, dependent or near dependent.
17.2 Accrual
Sick leave shall accrue to all full =time employees at the rate of eight (8) hours for each month of. •
continuous service,. No employee shall accumulate more sick, leave in any year than provided.
17.3 Relationship 'To Workers' Compensation
Benefits shall be payable in situations .where miscellaneous employee's: absence is due to
industrial injury as provided in.. California 'State Workers' Compensation Law. During the first
three (3) Workdays when the employee's absence from work has been occasioned by . injury

receive full pay. Following this period, 'sick leave may be a supplement to. the Workers'
Compensation benefits provided the employee. Compensation is at his/her regular rate fora
period not to. exceed six (6) irfonths,, or until sick leave is exhausted; or the disability is
abrogated, or 'that employee` is `certified "permanent and stationary'' by a. competent :medical
authority.. The City shall, pay him/her the regular salary, based on the combination 'of the
Workers' Compensation benefit plus. sick leave.
All public: safety :employees ,receiving full salaries 'in lieu of temporary disability payments
pursuant to Section 4850 of .the -Labor Code are entitled fo accumulate sick leave: , during such
periods of sick Leave. Sick leave for industrial injury ,shall not be. allowed for, a disability
resulting sickness, kness, self-inflicted injury or willful.misconduct.

The City may retire any employee prior to „the exhaustion of accumulated sick.,leave., at' which
time all accrued but unused sick leave shall be abrogated, subject only to'the limitations provided
under this Memorandum of Understanding.

17.4 Sick, Leave Transfer Policy, '
An employee to. donate hours of sick leave another employee, may do so by sending a
written request, approved by hi "s/her department head, to the Human. Resources Office naming
the individual to receive the sick leave and the amount donated,, with`the fo'l'lowing restrictions:

SECTION 19 - FAMILY MEDICAL CARE LEAVE

The-City will provide' family and medical care. leave for eligible employees a required by City
Policy, state and federal .law and as specifically provided in -the Federal Family and Med eaI

Leave Act o f 1993 (FMLA) and the California Family Rights Act of 1993 (CREA). If possible,
employees must provide thirty (3'0) days advanc¬ice of leave.
SECTION 20 - PREGNANCY DISABILITY. LEAVE
The City will provide pregnancy disability leave for eligible employees''as- required ;liy City policy
and state law; and as specifically provided in the Fair Employment - and Housing Act, and "the
California Family Rights Act 'of 1993. If possible employees must provide thirty (30,)' days
advance notice of leave.
SECTION 21 VICTIMS OF DOMESTIC VIOLENCE
California Labor Code; 230 and -230A allows use of such leave for Victims of Domestic Violence
for any of the following: to se& medical attention for related injuries; to obtain services from a
dorndstid. violence shelter, °program Or rape crisis center;, to obtain psychological ,couiiseling; or to
participate in safety planning. Certification of need. may be required in the form' of a police:
report, protection order--; documentation from court or from a inedical professional domestic
violence advocate, or °counselor.
SECTION 22 - HOLIDAYS
22.1 Fixed Holidays
The City shall observe twelve (12) fixed -date 'holidays: These holidays shall be established for
the'Citys fiscal year as determined by City Council resolution

Military leave shall be arranged,,in accordance with the provisions of State Law. All employees
entitled to military leave; shall give the - appointing power an opportunity within the limits of
military regulations °ao determine when such leave shall be taken:
SECTION 2'4 LEAVE OF ABSENCE WITHOUT PAY
The City Manager may grant a regular or probationary employee leave of absence without pay
pursuant to the State and Federal .Law., Good , cause, being; shown by a written request, the City
Manager may extend the leave of absence 'with outpay or senioritv.or benefits for an additional
period not to exceed - six (6) ;months. No such leave shall be granted except upon written request
of the employee setting,, forth, the reason for the request; ,and the .approval, will be' in writing,.
Upon expiration of a regularly approved' 'leave or within a reasonable period , of time after notice
to return to duty, the empl6y66' p he time leave was

SECTION 25;- ; ADMINISTRATIVE I,,EAVE
Members of this Unit, will be granted eighty (80) hours of'admimstrative leave, fiscal year.
Employees hired after July l will be eligible for-'a., "pro - rated" amount of administrative leave
depending on their date of 4dre. 'The, City shall pay off any unused Administrative Leave as of
June 30"' to a maximum of forty (40) hours. Payment shall be at the employee's base pay rate as
of June 30th. This payment shall be made on the last pay-period of the fiscal year
