3 RESOLUTION SETTING THE 1996 ALLOCATION POOL

6 WHEREAS, the City Council has adopted a growth management system by Ordinance
7 1716 N.C.S. (Chapter 17.26 of the Petaluma Municipal Code) establishing the procedure
8 for setting the allocation pool on a yearly basis; and

10 WHEREAS, interested developers have filed Notice of Intent to Develop forms in
11 accordance with the provisions of Chapter 17.26 and these, in combination with other
12 allocation obligations created and anticipated by the action of the City Council, comprise
13 the total number of allocation requests for 1996; and
14
15 WHEREAS, the setting of allocations must be done in conformance with General Plan
16 policy that permits a maximum annual average of 500 allocations, no more than 1,000
17 allocations in any year and no more than 1,500 allocations over three consecutive years;
18 and
19
20 WHEREAS, total requests for 1996 allocations equals 246 units; and
21
22 WHEREAS, there is no compelling reason to set the allocation pool higher than the
23 number of requested units this year; and

25 WHEREAS, the City Council finds the setting of allocations is not a project pursuant to
26 Section 1578 of the California Environmental Quality Act and, therefore, no environmental
27 action is necessary at this time; and

29 WHEREAS, the City Council met on April 17, 1995, and discussed the setting of the pool
30 for 1996 allotments;

32 NOW, THEREFORE, BE IT RESOLVED that the City Council sets the 1996 allocation
33 pool at 246 units.

35 BE IT FURTHER RESOLVED that the City Council makes the following findings in
36 support of its setting the 1996 allocations pool:

1 Findines:
2 1. The number of available 1996 allotments is consistent with the provisions of the
3 Residential Growth Management System Ordinance (Chapter 17.26 of the
4 Petaluma Municipal Code) and the applicable policies of the 1987-2005 Petaluma
5 General Plan.

7 2. The City Council need not consider the 1996 Development Objectives in
8 determining the 1996 allocation pool because the number of requested allocations
9 was less than 500.

11 3. The decision to set the 1996 allocation pool at 246 is not detrimental to the public
12 health, safety or welfare because the City Council has considered. the 1996
13 allocation pool in the context of overall City-wide growth rates, adequacy of public
14 facilities, and the timing of development, and this pool satisfies all applicants.
