These restrictions promote the health and safety of residents, visitors, and employees of the City of Petaluma. Currently, Petaluma Municipal Code section 8.20.050 prohibits smoking inside the city's enclosed facilities and vehicles. `The City Council has requested an amendment to Chapter 8.20 prohibiting smoking within 20 feet of the city's enclosed facilities and. vehicles. EXECUTIVE Su1yImmky The attached ordinance amends .Petaluma, Municipal Code Section 8.20.050 io specifically prohibit smoking within 20 feet of the city'sl enclosed facilities and vehicles. 2. BACKGROUND Petaluma Municipal Code Chapter 8.20 establishes restrictions on smoking to reduce, the health hazards associated with secondhand tobacco smoke. These restrictions promote the health and safety of residents, visitors, and employees.of the City of ' Petaluma. Currently, Petaluma Municipal Code section 8.20:050 prohibits :smoking .inside the city's. ,enclosed facilities and vehicles. Seconded by 10 11 12 13 AN ORDINANCE OF THE COUNCIL OF THE CITY OF PETALUMA AMENDING 14 PETALUMA MUNICIPAL. CODE SECTION 8.20.050. TO PROHIBIT SMOKING 15 WITHIN 20 FEET OF THE CITY'S ENCLOSED FACILITIES AND VEHICLES 16 17 18 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS 19 FOLLOWS: Q 1 21 Section 1 . Amendment: Petaluma. Municipal Code section ,8.20.050 is hereby amended 2 to add the following provisions: 23 24 "Section 8.20.050. City -owned facilities. 25 26 A. All vehicles owned, leased, or operated under 'the authority of the city 27 of Petaluma and all enclosed facilities owned, leased, or operated by 28 the city of Petaluma or otherwise under the control of the Petaluma 29 city council shall be subject to the provisions of this chapter. 30 B. Smoking shall occur at a distance of twenty (20) .feet or more outside 31 any enclosed facility or vehicle, as described in subpart (A), where 32 smoking is prohibited, to insure" that tobacco smoke does not enter 33 through entrances, windows, ventilation systems or any other means. 34 35 Section 2 . If any section, subsection, sentence, clause or phrase or word of this ordinance 36 is for any reason held to be unconstitutional, unlawful or otherwise invalid by a court of 40 7 competent jurisdiction, Esuch decision shall not affect the validity of the remaining portions of 8 this ordinance. The City Council of the City of Petaluma hereby declares that it would have 1 2 a 1 passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that 2 any one or more of said provisions be =declared, unconstitutional, unlawful or otherwise invalid. 3 4 Section 3! . This ordinance shall become effective thirty (30) days after `the date of its 5 adoption by the Petaluma City Council. 7 Section 4 .
