That the proposed amendment is deemed to be in the public interest. The Amendment to 11 the General Plan map will allow. the City to obtain additional parkland at no cost to the 12 City as well as provide needed additional housing. A park is vitally needed in the 13 neighborhood. The City does riot have the necessary funds to acquire or maintain the 14 parkland. The developer is also offering a maintenance annuity. The Gossage Avenue site 15 currently contains a chicken ranch that is not compatible with the adjacent residential 16 uses. The land proposed for development is within the City's Urban Limit Line and 17 Sphere of Influence, therefore is slated for development, The proposed drainage system 18 will handle not only increased drainage from the proposed development, but will handle a 19 portion of the current drainage and storm water flows during peak flows as well. 20 Improvements to Magnolia Avenue will increase safety for pedestrians. 21 22 2. That the proposed General Plan amendment is consistent and- compatible with the rest of 23 the General Plan and any, implementation programs that may be affected. The General 24 Plan amendment furthers a number of objectives, policies and goals of the General Plan, 25 which are listed in th'e 'Initial Study. The development will be within the Urban Limit 26 Line and Sphere of Influence, be harmonious with its setting and enhance the City's 27 image; improve the appearance function and safety of Magnolia Avenue; provide 28 additional parkland to Help the City meet its adopted minimum standards; assist in 29 providing a range of housing types, including higher - value housing; and improve 30 drainage in the area. 31 32 3. That the potential impacts of the proposed amendment have; been assessed and have been 33 determined not to be detrimental to the public health; safety, or welfare. An Initial Study 34 of Environmental Significance was completed and it was determined that the project, 35 with the incorporation of mitigation measures, will reduce potential impacts to less than 36 significant. In addition, the provision of a new neighborhood park, street and drainage 37 improvements will be beneficial to the public health, safety and welfare. 38 39 4. That the proposed amendment has been processed in 'accordance with the applicable 40 provisions of the California Government .Code and, the California Environmental Quality 41 Act. The applicant provided an Environmental Impact Questionnaire and numerous 42 environmental studies with 'the application. An Initial' Study of potential environmental 43 impacts was prepared and referred to all responsible agencies and agencies with 44 jurisdiction over natural resources affected by the project held in 'trust by the State. A 45 Notice of Intent, to. adopt a Mitigated Negative D'eclarati "on, which delineated the review 46 period, was published in a newspaper of general circulation, as well as sent to all Page 2 1 residents and property owners within 500 feet of the proposed development. The C 2 potential for the .significant impacts to. geology and soils, air, hydrology and water, noise, 3 visual quality and aesthetics, biological resources and cultural resources were identified. 4 Mitigation measures were proposed and agreed to by the applicant that will reduce 5 potential impacts to less than significant. 6 Page 3
