1 RESOLUTION ORDERING ABATEMENT OF NUISANCES
2 CONSISTING OF WEEDS GROWING UPON PUBLIC AND
3 PRNATE PROPERTY IN THE CITY OF PETALUMA AND
4 ORDERING THE FIRE CHIEF TO REMOVE SAID WEEDS,
5 BY CONTRACT OR BY HIS OWN FORCES

8 WHEREAS, on the 21st day of March. 1995, the Council of the City of
9 Petaluma adopted Resolution No. 95-71 IV.C.S, declaring that weeds growing
10 upon public and private property referred to and described in said Resolution,
11 constituted and wex•e a public nuisance and fixed the 3rd day of April 1995, at the
' 12 hour..of 7:00 p.m., or as soon thereafter as can be heard, in the Council Chambers
13 of the City Hall, Petaluma, California, as the time and place of hearing protests
14 and objections to said abatement proceedings; and,

J~i WHEREAS, the City Clerk of the City of Petaluma caused notice to destroy
77 weeds to be mailed in the manner required by Sections 39500 through 39587 of the
18 Govex•nment Code, as shown by the certificate of said City Clerk filed hex•ein; and,

20 WHEREAS, the City Council has held its hearing and considered all
21 objections or protests to the proposed removal of weeds and has allowed or
22 overruled any or all objections, as hereinafter set forth, and the City Council has
23 now ,acquired jurisdiction to proceed and perform the work of x•emoval of said
24 weeds;

26 NOW THEREFORE, BE IT RESOLVED that the City Council does hereby
27 order the Fire Department of the City, through a contractor employed by this
28 Council or its own forces, to abate said nuisances by removing said weeds by
29 means of mowing, discing, or blading using whichever means it deems to be the
30 most appropriate after considering the location and the terrain of said parcels of
31 public and private property referred to and described in said Resolution No. 95-71

1 N.C.S: Said mowing, discing and blading shall be accomplished as many times
2 as the Fire Department may deem necessary to provide the best possible control of
3 weeds.

5 BE IT FURTHER RESOLVED that said Fire Department shall keep an
6 account of the cost of this abatement of said nuisances on public and private
7 property where the work is done, and thereafter submit to this Council f'or
8 confirmation, an itemized written report showing such cost as required by Section
9 39547 of the Government Code, and thereafter such proceedings shall be had for
10 special assessments against the respective parcels of land to pay fox• the cost of
11 said work, in the manner provided by Chapter 13, Part 2, Division 3, of Title 4 of
12 the Government Code.
