HomeMy WebLinkAboutResolution 95-079 03/20/1995 Resolution No. 95-79 N.C.S. 1 of the City of Petaluma, California 2 3 4 A RESOLUTION OF THE CITY COUNCIL OF 5 THE CITY OF PETALUMA APPROVING AN AMENDMENT TO THE 6 CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY FOR A-1 TAXI TO 7 INCREASE THE NUMBER OF TAXICABS OPERATED IN PETALUMA FROM 2 8 TO 10 9 10 WHEREAS, Walter Watkins, Daniel Watkins, and Rodney Leight have applied for an 11 amendment to their Certificate of Public Convenience and Necessity for A-1 Taxi to 12 operate an additional eight taxicabs in Petaluma; and 13 14 WHEREAS, the proposal was found to be exempt from CEQA Guidelines pursuant to 15 Section 15301 (c), Class 1, which exempts the operation of existing public or private 16 structures and facilities; and 17 18 WHEREAS, a public hearing was held on 28 February 1995 before the Planning 19 Commission to consider the amendment to the Certificate held by the taxicab company; 20 and 21 22 WHEREAS, the Planning Commission voted to recommend approval of both the proposed 23 CEQA exemption and the proposed amendment to the Certificate of Public Convenience 24 and Necessity for A-1 Taxi; and 25 26 WHEREAS, the request was heard on the 20th day of March 1995 before the City Council 27 at which time information was heard and consideredby the Council. 28 29 NOW, THEREFORE, BE IT RESOLVED that it is ordered and declared that the City 30 has found the proposal by the taxicab company to increase the number of taxicabs from two 31 to ten to be exempt. from the requirements of CEQA; and that A-1 Taxi be allowed to 32 operate an additional eight taxicabs (for a total of 10), based on the following findings and 33 subject to the following conditions: 34 35 Findines: 36 37 1. The proposed expansion of the taxi company services, as conditioned, will conform 38 to the requirements and intent of the Petaluma Municipal Code and the Petaluma 39 Zoning Ordinance. ass. n'a.. 9.5-79 vca 1 1 2 2. The proposed expansion of the taxi company services, as conditioned, will conform 3 to the requirements and intent, goals, and policies of the Petaluma General Plan. 4 5 3. The proposed expansion of the taxi company services, as conditioned, will not 6 constitute a nuisance or be detrimental to the public welfare of the community. 7 8 Conditions: 9 10 1. A-1 Taxi shall comply with all applicable provisions of Petaluma Municipal Code 11 Chapter 14. 12 13 2. A-1 Taxi shall be permitted to operate a total of ten (10) taxicabs inside City of 14 Petaluma city limits. Any proposal for increase in the number of taxicabs shall be 15 reviewed and approved by the City Council before expansion. of service is made. 16 17 3. The business address for A-1 Taxi shall be 372 Park Place Drive, APN 149-430-009. 18 A relocation of the business to another address shall result in this certificate being 19 void, and shall be subject to review and approval by the City Council before 20 operations may re-commence. As proposed by the applicants, all cabs shall be 21 garaged at 1590 Eucalyptus Avenue, such location and proposed use being subject 22 to review and approval by the Sonoma County Planning Department. A copy of the 23 Sonoma County Planning Department approval shall be provided to the City before 24 the commencement of operation of the additional 8 taxicabs. A relocation of the 25 storage of the cabs to an address inside city limits shall be subject to review and 26 approval by the City Planning Department. 27 28 4. The fare rates as approved by the City Council 11/21/94 by Resolution 94-310 are 29 still in force, and may only be changed by City Council action. 30 31 5. This Certificate of Public Convenience may be suspended or revoked for violation 32 of any of the terms of Chapter 14 of the Petaluma Municipal Code, or for violation 33 of any of the terms of the certificate, or for misuse or abuse of the privilege hereby 34 granted, pursuant to Chapter 14 of'the Petaluma Municipal Code. 35 Reso. 95-79 NCS 2 1 6. Before any of the additional vehicles may be operated, the additional vehicles shall 2 be inspected by the Police Department. Any defects uncovered during the 3 inspection. shall be corrected and the vehicles reinspected by the. Police Department 4 prior to commencement of use. 5 6 7. All drivers of A-1 Tani vehicles shall maintain a (taxi) driver's license issued through 7 the Central Permit Bureau (Finance Department of the City of Petaluma) before 8 commencement of operations. 9 10 8. All vehicles owned and operated by A-1 Taxi shall obtain annual vehicle permits 11 issued through the Central Permit Bureau (Finance Department of the City of 12 Petaluma) before commencement of operations. All permits for taxicabs shall 13 expire annually the thirtieth day of June. 14 15 9. Before a vehicle permit may be issued, and prior to the operation of any of such 16 vehicles, there shall be filed with the City Clerk a policy of public liability insurance 17 executed and delivered by a company authorized to carry out any insurance business 18 in the state, the financial responsibility of which company has been approved by the 19 City Manager. 20 21 10. Drivers shall not meet or congregate, nor shall taxis be garaged at 372 Park Place 22 Drive. 23 24 25 altaxres~jktl4 Under the power and authority conferred upon this Council by the Charter of said City.
