To assist you in yourdiscussions regarding the. Campaign Finance Ordinance, scheduled
for the March 3, 2003 Council`meeting, please find attached the following:
(1) Santa Rosa•Campaign Finance. Ordinance (requested to be submitted by Council
,Member Moynihan);
(2) Memo to the Council from Richard Rudnansky dated August 3, 2001;
(3) Redlined revised" version of the Petaluma Campaign Finance Ordinance discussed
® by the City Council on August 13, 2001 but never formally adopted; and
(4) Memo to Council from Richard Rudnansky dated October 11, 2001 attaching
memo from Steven ChurcbweD dated October 10, 2001 which includes his comments and
recornmendations`regarding the revised proposed ordinance which was discussed by the Council
on August 13, 20,01, but never formally adopted by the Council (see item 4 above):

Having now had an, opportunity to more fully review thecurrent campaign finance
ordinance and the campaign finance ordinance being proposed by Council member Hediv.
particularly takinginto account, the �enfbrcement of any violations, f believe that-,there,are:Few
areas that should beclarified: in the,ordi-,nance.
One question would, 'be,who is, considereda- ",candidate and when is that person -is
considered a"candidAte" for'purposes of the ordinance. At,this-time. "candidate" is not
specifically defined in the -ordinance and, -therefore. thery may be a,question asto how to treat
the recei I Pt:offunds; by incumbents duringelectioncycles and f6cei0t offlinds by individuals,
prior to their announcement or filing as a candidate for lee. Without any specific, or additional
definition in thd- ekistinwordiriance the definition of candidate as set. forth in. the -Political Reform
Act at Governme.rit Code §8200.7 (attached). would' be, used. H-Low--e-Ver.itwould, beMN- sugges�tion
that. the . Council consider provisions for the ex I isting, ordinance or the prpposed,revised ordinance
which would Airther,clari6ing the matter.
In, this regard you may wish to further define candidate: in a manner similar to the Santa
Rosa, Ordinance as, follows
"Candidate means any person Who is a candidate fQr Mayor or City Council- for
the City of"Peteauma including incumbent Mayors or Council Members,

To further clarify and assist in the interpretation of the ordinance Preconunend adding the
following language (limilar to the, Santa Rosa. Ordinance) 'to the Petaluma Ordinance:

Under the Enforcement provisions of the Ordinanceyou;ra_av wish to consider adding the
followin9 provision which, is similar toa Provision, in the, -,Santa Rosa, Ordinance:

1.30.040 - Disclosure Reouirement.
A. Each candidate for city council or mayor, or candidate committee, shall provide
detailed itemization, as,.defined in the California Political Reform Act of 1974, for
all contributions received in excess of Fifty Dollars ($50:00}, - g - fie- 0; deilf.
B. Each candidate for city council or mayor, or .candidate shall file a third pre-
election Campaign Disclosure Statement (Form 460), as provided by the
California Fair Political Practices Commission for the period from the end of the
period covered by the second pre -election statement to 1 i:59 PM on the third
business day immediately preceding election day (normally Thursday). Such
statement shall be. filed with the Clerk of the City of Petaluma by 5:00 FM -on the
second business, day'immediately preceding. election day (normally -Friday).
C. Each candidate, and each committee, person or entity making independent
expenditures, who 'sends a mailing or distributes more than 200 substantially
similar pieces of campaign literature shall deliver send a, copy of the mailing or
other literature to the City Clerk at the.same time-the,mailing or other, °literature is
given to the post office or otherwise distributed. During' the election campaign,
the City Clerk merely'serves as a repository for such,literature and shall not judge
or comment on the contents of such literature. All,Wrature so delivered shall be
available for inspection in the City Clerk's office ,during regular business
hours.
1.30.042. - Aeerenation of Contributions,
For purposes- of .the contribution limitations contained in this chapter, the following
provisions shall apply:
A All contributions made'by a. sponsored committee to a candidate for City Council
or Mayor f or to a committee controlled by such candidate) shall be, combined with
those contributions made during the same Election Cycle by the sponsor(s) of the

I committee. Consistent with the definition and use of the terms 'sponsored
2 committee" and "sponsor" in the Political -Reform Act, the term "sponsor" shall
3 not include.individuals.
4 B. Contributions received film the following combinations of individuals and
5 entities must be aggregated to determine the cumulative amount of contributions.
6 received from=a contributor.
7 '(1) Contributions from: an individual who makes contributions' from personal
g fiords and who also has sole authority to direct and control contributions
9 made.from other funds.
10 (2) Contributions from 'business entities, in a parent -subsidiary relationship
11 and 'busiiness entities, with the same controlling owner (more than 50
12 percent), unless the entities act -completely independently in.their decisions
13, to make contributions.
14 (3) Contnbutions' from any member of entities or committees if the same
15 person or a majority of the same. persons in fact directs and controls the
16 contributions each entity makes. This subdivision shall not apply to
17 treasurers,of committees if these°treeasurers do not Participate hi,or control
l g inany way a decision on whether the candidate or candidates received
19 contributions.
20 C. Contributions bya_married person shall be treated as the separate contributions of
21 such.person:aad shall not be aggregated with any contributions of the spouse of
22 such person.
23 D. Contributions by children underocighteen (18) years of age shall be treated as
24 contributions by their parent(s) or legal guardian(s), one-half to each parent or
25 guardian unless only one parent or guardian has legal custody of such child in
26 which event any such- contributions shall be attributed solely to the custodial
27 parent_

A. The city council is empowered to create an advisory committee and other

Any registered elector of the city may bring a civil, action including, without
lunitatiM an ,action for injury, and may sue for injunctive relief to enjoin
violations or to,-coinpel.compliance with this,.ordinanceLconsistent with D. a nd F.,
below,, provided such person -fast files, with the city attorney a written request for
11 the city attorney to commence action. The request shall include a statement of
12 grounds for believing a cause of action exists. The city attorney or_any attorney

I was on vacation at the:time,oftheCity Council meeting of August 13, 2001, it is my
understanding the manychanges to the existing: Ordinance were discussed
