TO: Mayor and' Members + of the Petaluma City Council
FROM: Richard Rudnansky
SUBJECT: Petaluma Campaign Tinance Ordinance
The Council will consider amending the`existing, Campaign Finance Ordinance. Although
I was ron vacation at the time oftheCity Council meeting of August 13, 2001, it is my
understanding the manychanges to the existing Ordinance were discussed
Since that time, attorney Steven Churchwell was retained to investigatea claim by a
citizen ( 'the first such claim under the existing Ordinance).
Because Mr. Churchwell, handled :the first claiin_raised'under the existing ordinance and
because he is very experienced in this area of the law, having once served. as General Counsel for
the Fair Political Commission, I asked him to'mview the proposed amended Ordinance
(i.e. the proposed version in the October 15' Agenda packet) °an d provide comments.
Attached are Mr: Churchwell'&comments for your consideration.

I would delete. State law' already has a "one bank account" rule that applies to local
candidates.
130.070 - Indenandeat Exgenditures.
In A., I would cage the referenee Form 460.to Form % 465. The Fo= 460 does
not fit independent expenditures very well, and that -much detail is pretty invasive from a
constitutional point of view for an independent expenditure.
Subsection B. is unconstitutional, inrpy opinion, as.forced speechlbat interferes with
core p liticA sperech. T,he Clem'& form mandated in subsection A. could include
