APPROVING THE PROJECT BUDGET AND AUTHORIZING THE AWARD OF
CONTRACT FOR THE ELLIS CREEK WATER RECYCLING FACILITY SITE
ACCESS IMPROVEMENTS PROJECT TO BENCHMARK CIVIL CONSTRUCTION
WHEREAS, City staff has prepared construction bid documents and advertised for
construction of this Project; and,
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code,
California Public Contract Code Section 20162 and other applicable law, City staff solicited bids
for the Project; and,
WHEREAS, the Project was bid on March 30, 2011, and six (6) bids were received and
opened in accordance with applicable law; and,
WHEREAS, the lowest bid for the Project was from Benchmark Civil Construction for
$28,979; and,
WHEREAS, staff has determined that Benchmark Civil Construction's bid satisfies the
bidding requirements for the Project; and,
WHEREAS, staff has verified that Benchmark Civil Construction possesses a valid
California Contractor's License, Class A, number 957791 that qualifies Benchmark Civil
Construction to perform the Project; and,
WHEREAS, the Project is exempt pursuant to California Environmental Quality Act
( "CEQA ") pursuant to Title 14, the California Code of Regulations ( "CEQA Guidelines "),
Section 15301, as the minor alteration of existing public facilities with negligible or no
expansion in use.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City hereby:
Approves the Project Budget in the amount of $62,979.
2. In accordance with the City of Petaluma Charter and Municipal Code, California
Public Contract Code Section 20162 and other applicable law, waives any and all
non - conformance in the bid of Benchmark Civil Construction for the Ellis Creek
Water Recycling Facility Site Access Improvements Project, finds the bid of
$28,979 to be the lowest, responsive bid and further finds that Benchmark Civil
Construction is the lowest responsible bidder.
3. Awards the contract for the Ellis Creek Water Recycling Facility Site Access
Improvements Project to Benchmark Civil Construction, in the amount of
$28,979, the amount of the lowest responsive bid, conditioned on Benchmark
Civil Construction timely executing the project contract and submitting all

required documents, including but not limited to, executed bonds, certificates of
insurance, and endorsements, in accordance with the project bid documents.
4. Directs staff to issue a notice of award to Benchmark Civil Construction.
Authorizes and directs the City Manager to execute the project contract on behalf
of the City of Petaluma upon timely submission by Benchmark Civil Construction
of the signed project contract and all other required documents, including but not
limited to, executed bonds, certificates of insurance, and endorsements, in
accordance with the project bid documents.
Under the power and authority conferred upon this Council by the Charter of said City.
