2 A RESOLUTION OF THE CITY COUNCIL DENYING THE TREE STUDY AS IT
3 ADDRESSES THE COMPONENT OF EMERGENCY VEHICLE ACCESS TO MCNEAR
4 AVENUE AS PROPOSED FOR THE COUNTRY CLUB ESTATES 2a/3a SUBDIVISION
5
6 WHEREAS, the City Council of Petaluma approved the Country Club Estates Unit 2a/3a
7 Subdivision in November of 1992; and,
8
9 WHEREAS, the City Council imposed numerous conditions of approval and mitigation
10 measures as contained in the Resolutions of approval; and,
11
12 WHEREAS, one of the mitigation measures required the preparation of a Tree Study to
13 evaluate the potential impacts of the subdivision improvements upon trees on the site; and,
14
15 WHEREAS, the City Council also imposed a mitigation measure and conditions of
16 approval requiring that secondary emergency access be provided for the development of
17 the subdivision; and,
18
19 WHEREAS, a mitigation measure was imposed requiring establishment of an alignment of
20 the secondary emergency access extended from McNear Avenue if feasible; and,
21
22 WHEREAS, the developer has prepared a preliminary design for a secondary emergency
23 access along an alignment extended from McNear Avenue; and,
24
25 WHEREAS, the City has contracted with a consulting arborist to prepare a Tree Study
26 evaluating the impacts of the subdivision including the preliminary alignment of the
27 emergency access extended from McNear Avenue; and,

1 WHEREAS, the Tree Study was presented to the Planning Commission at their November
2 22nd and December 13th 1994 meetings; and,

4 WHEREAS, the Planning Commission approved the Tree Study with minor modification;
5 and,
6
7 WHEREAS, during the Planning Commission's discussion of the Tree Study, neighbors
8 raised questions regarding the secondary emergency access alignment extended from
9 McNear Avenue; and,
10
11 WHEREAS, the Country Club Estates Unit 16 Homeowner's Association appealed the
12 approval of the Tree Study to the City Council noting their opposition to the proposed
13 secondary emergency access alignment; and,
14
15 WHEREAS, the City Council considered this appeal during public hearings at their
16 January 17 and February 6, 1995 meetings at which time the City Council received
17 considerable testimony regarding the alignment of the secondary emergency access.

19 NOW THEREFORE BE IT RESOLVED that the City Council of the City of Petaluma
20 hereby finds as follows:

22 1. The alignment of the secondary emergency access extended from McNear Avenue
23 appears to create significant environmental impacts and does not appear to be a
24 feasible alignment.
25 2. The secondary emergency access alignments from the Nizibian Subdivision appears
26 to present operational difficulties for emergency services and do not appear to be
27 optimal access routes.

1 3. Additional alignments for the secondary emergency access should be developed by
2 the project proponent for evaluation by City staff and the City Council.
3 4. The appeal of the Tree Study is hereby tabled. The Tree Study shall be amended
4 upon the identification and acceptance of an appropriate secondary emergency
5 access toute to identify and mitigate the impacts to trees presented by this access.
6 5. The environmental effects of the secondary emergency access shall be evaluated
7 through the preparation of an Initial Study for consideration and adoption by the
8 Site Plan and Architectural Review Committee in conjunction with their review of
9 the revised Tentative Subdivision Map and the Tree Study.
10 6. The loss of significant trees in order to establish the alignment for the secondary
11 emergency access extended from McNear Avenue through a public park is
12 unacceptable.
