HomeMy WebLinkAboutResolution 95-149 06/19/1995 Resolution No. gs-149 N.C.S. of the City of Petaluma, California 1 A RESOLUTION DESCRIBING IMPROVEMENTS AND DIRECTING PREPARATION 2 OF ENGINEER'S REPORT FOR FISCAL YEAR .1995-96 3 ANNUAL ASSESSMENT FOR 4 LANDSCAPE ASSESSMENT DISTRICTS 5 6 WHEREAS, pursuant to the provision of the Landscaping and 7 Lighting Act of 1972, Part 2, Division 15 of the Streets and 8 Highways Code of the State of California, the City Council 9 conducted proceedings for the formation of Landscape Assessment 10 Districts and Authorizing Levy and Collection of Assessments 11 Pursuant to Landscaping and Lighting Act of 1972, as listed in 12 Exhibit A attached hereto; 13 14 NOW, THEREFORE, BE IT RESOLVED by the Council of the City of 15 Petaluma, County of Sonoma as follows: 16 17 1. The public interest, convenience and necessity require, 18 and it is the intention of said Council to undertake proceedings 19 for the levy and collection of assessments upon the several 20 parcels of land in said districts, for the construction or 21 installation of improvements, including the maintenance or 22 servicing, or both, thereof for the Fiscal Year 19.95-96; 23 24 2. The improvements to be constructed or installed, 25 including the maintenance or servicing, or both, thereof, are 26 more particularly described for each District in Exhibit B 27 attached hereto; 28 29 30 3. The costs and expenses of said improvements, including 31 the maintenance or servicing, or both, thereof, are to be made 32 chargeable upon said districts, the exterior boundaries of each 33 district are the composite and each consolidated area as more 34 particularly shown on a map thereof on file in the office of the 35 City Clerk of the City of Petaluma, to which reference is hereby 36 made for further particulars. Said maps for each District 37 indicates by a boundary line the extent of the territory included 38 in said district and of any zone thereof and shall govern for all 39 details as to the extent of each assessment district; 40 41 4. The Director of Engineering of Petaluma shall be the 42 Engineer of Work, and is hereby directed to prepare and file with 43 the City Clerk a report on the districts specifying the fiscal 44 year to which the report applies, and, with respect to that year, 45 presenting the following: 46 47 a) Plans and specifications of the existing improvements 48 and for proposed new improvements, if any, to be made 49 within the assessment district or within any zone 50 thereof; a~a. rca..9,5-149.......... n~.cs. 1 b) An estimate of the costs of said proposed new 2 improvements, if any, to be made, the costs of 3 maintenance or servicing, or both, thereof, and of 4 any existing improvements, together with the 5 incidental expenses in connection therewith; 6 7 c) A diagram showing the exterior boundaries of the 8 assessment district and the lines and dimensions of 9 each lot or parcel of land within the district as 10 such lot or parcel of land is shown on the County 11 Assessor's map for the fiscal year to which the 12 report applies, each of which lots of parcels of land 13 shall be identified by a distinctive number or letter on 14 said diagram; and 15 16 d) A proposed assessment of the total amount of the 17 estimated costs and expenses of the proposed new 18 improvements, including the maintenance or servicing, 19 or both, thereof, and of any existing improvements upon 20 the several parcels of land in said district in 21 proportion to the estimated benefits to be received 22 by such parcels of land from said improvements, 23 including the maintenance or servicing, or both, 24 thereof, and of the expenses incidental thereto. 25 26 5. The Director of Parks and Recreation andjor the Director 27 of Finance of Petaluma is hereby designated as the person to 28 answer inquiries regarding any protest proceedings to be had 29 herein, and may be contacted during regular office hours at the 30 Petaluma City Hall, P.O. Box 61, 11 English Street, Petaluma, CA 31 94952, or by calling 707-778-4380. Underthe power and authority conferred upon this Council by the Charter of said City.
