2 A RESOLUTION APPROVING A TENTATIVE MAP FOR THE PAMELA PLACE
3 SUBDIVISION CREATING 5 SINGLE FAMILY RESIDENTIAL LOTS ON A3.46 ACRE
4 PARCEL LOCATED AT 911 SUNNY SLOPE ROAD, WEST OF "I" STREET, APN 019-
$ 201-O18

7 WHEREAS, Mr. Lawrence A. Jonas has filed with this Council a Tentative Subdivision
8 Map to subdivide a 3.46 acre parcel into 5 single family residential lots, and has paid all
9 required filing fees; and
10
11 WHEREAS, this project is exempt from the requirements of the Calfotnia Environmental
12 Quality Act (CEQA) pursuant to Section 15162 because a Final EIR was prepared and
13 certified for the Sunny Slope Annexation Area which included the project site, and since
14 the proposal does not raise any significant environmental issues not adequately addressed
15 in that environmental document; and
16
17 WHEREAS, the Planning Commission considered the project at their May 9, 1995 meeting
18 at which time the Commission recommended that the City Council conditionally approve
19 the Tentative Map; and
20
21 WHEREAS, the City Council has adopted Ordinance No. lygZ N.C.S. rezoning the
22 Pamela Place subdivision site to Planned Unit District, and Resolution No.95-143 N.C.S.
23 approving'the Pamela Place Subdivision Planned Unit Development Plan.

25 NOW, THEREFORE, BE IT RESOLVED, that this Council hereby finds as follows:
26
27 Findings for Tentative Mao
28
29 1. The proposed subdivision, as conditionally approved, together with provision for its
30 design and improvement, as consistent with the General Plan as awell-designed
31 development that is harmonious with its setting and provides adequate access and
32 services to the proposed lots.
33
34 2. The site is physically suitable for the type of lower density single-family residential
35 development proposed, as conditionally approved as the majority of the site is
36 relatively flat and free of physical constraints.
37
38 3. The Tentative Map provides reasonable public access from Sunnyslope Road on a
39 private road to the proposed lots.
40
41 4. The proposed map, subject to the following conditions, complies with the
42 requirements of the Municipal Code, Chapter 20.20 and the Subdivision Map Act by
43 following the procedure for application of Parcel Map Subdivision as provided
44 therein.
45
46 5. The proposed mad is exempt from the requirements of the California
47 Environmental QuahtY Act (CEQA) guidelines pursuant to section 15162 because a
48 Final EIR was certified and adopted at the time of the Sunnyslope Area
49 Annexation.

51 6. The design of the subdivision and the proposed improvements will not cause
52 substantial environmental damage, and no substantial or avoidable injury will occur
53 to fish or wildlife or their habitat because the property is not proximate to any

1 waterways and the property is already a developed site within an urbanized area
2 with no significant wildlife habitat present.

4 7. The design of the subdivision and the type of improvements will not cause public
5 health problems as the improvements rncluding sanitary sewer, storm drains and
6 water systems will be designed to the satisfaction of the City Engineer.

8 Conditions of the Tentative Subdivision Map:

10 1. The PUD Development Plan shall be revised to show the following prior to
11 approval of the Final Subdivision Map:
12
13 a. On L.ot 5, the precise building envelope shall be reviewed and approved by
14 administrative SPARC review prior to building permit application.
15
16 2. The following conditions of the City Engineer shall be met prior to Final Map:
17
18 a. The developer shall comply with all requirements of the Petaluma Municipal
19 Code including but not limrted to Chapter 20 SUBDIVISIONS.
20
21 b. Pursuant to Municipal Code Section 20.32.200, City Standard sidewalk shall
22 be installed across the subdivision's Sunnyslope frontage. Additional right-
23 of-way may be required if necessary to accommodate the sidewalk and any
24 planter step.

26 c. Pursuant to Municipal Code Section 20.36.140, all overhead utility
27 distribution facilities shall be placed underground.
28
29 d. The entrance driveway shall be to City Standards and centered on Pamela
30 Place. The existing storm drain catch basin on Sunnyslope Road shall be
31 relocated to allow for the centering of the driveway.

33 e. Pamela Place roadway structural section shall be designed based on the
34 City's Minor residential Street Traffic Index or as recommended by a Soils
35 Investigation Report prepared for this project,. whichever is greater.
36 Adequate area to provide for parking, as shown on the Tentative Map typical
37 Section A-A, shall be constructed of the same structural section as
38 determined for Pamela Place.

40 f. The downstream storm drain system shall be verified by a professional civil
41 engineer to be adequate to carry the additional surface runoff generated by
42 this project. A 100-year storm drain relief Swale shall be provided to
43 guarantee no habitable structures will flood in the event the storm drain pipe
44 system fails during a one (1%) percent frequency storm. The relief Swale
45 shall be contained in a dedicated surface easement. Sonoma County Water
46 Agency shall review and approve this project prior to Final Map approval.

48 g. Positive lot drainage for each lot shall be provided to the street (Pamela
49 Place).

51 h. No parking provisions shall be provided on the easterly side of Pamela Place.

1 i. All improvements proposed to be maintained privately shall be documented
2 in either a maintenance agreement or in convenants, conditions and
3 restrictions to assure the upkeep and maintenance.

5 3. The following site drainage improvement shall be shown on the improvement plans
6 prior to Final Map:

8 a. The drainage Swale shall be continued along the northwest property line of
9 lot 5.
10
11 4. The following private road improvements shall reflected on the improvement
12 drawings prior to Final Map:
13
14 a. Signs reading "No Parking -Fire Lane" shall be installed on the west side of
15 the road.
16
17 b. A stop sign shall be installed at the opening of the road at Sunnyslope Road.
18
19 5. Common Parcel "A", containing the private road, private sewer system and
20 landscape improvements along the private road, shall be owned and maintained by a
21 Homeowner's Association or other vehicle acceptable to the City Engineer.
22
23 6. Trees to be retained or removed shall be shown on plans at time of building permit
24 submittal.
25
26 7. Trees to be preserved shall be enclosed with temporary protective fencing five foot
27 outside the drip line prior to, and during all grading and construction activities.
28
29 8. Buildings located on property lines shall be demolished or relocated to provide the
30 minimum setback prior to Final Map approval.
31
32 9. Applicant shall be required to pay low and moderate income housingg in-lieu fees of
33 an amount to be determined according to the schedule established by City Council
34 Resolution No. 84-199 N.C.S., or make alternative arrangements to meet low and
35 moderate income housing provision requirements of the Petaluma General Plan
36 subject to approval of the City and prior to Final Map approval.

38 10. All requirements of the Fire Department shall be met:
39
40 a. Provide either a clear unobstructed access to Lot 5 or an approved gate at
41 the end. of the fire apparatus turn-around.
42
43 b. Provide an address locator at the driveway entrance of Pamela Place and
44 Sunnyslope Road for lots setback off the street. Address locator design to be
45 approved by the Fire Marshal's office.
46
47 c. Post address at or near main entry door -minimum four (4) inch letters.
48
49 d. Relocate proposed fire hydrant near Lot 1 onto the frontage of Sunnyslope
50 Road.

52 e. Residential buildings less than 3,500 square feet in floor area are required to
53 have a fire suppression system at normal sources of ignition. These areas are

1 s~lecifically at clothes dryers, kitchen stoves, furnaces, water heaters,
2 fireplaces, and in attic areas at vents and chimneys.

4 f. Residential buildings constructed over 3,500 square feet in area are required
S to have a residential fire sprinkler system designed and installed in
6 accordance with N.F.P.A. 13-D, including attics, garages, bathrooms with
7 combustible fixtures, bathrooms over 55 square feet and closets over 24
8 square feet or over 3 feet deep.

10 g. All roof covering material shall have a Class "B" rating or better treated in
11 accordance with the Uniform Building Code Standard 32.7 per the City of
12 Petaluma Ordinance 1744.

14 h. All roof covering materials applied as exterior wall covering shall have a fire
15 rating of Class "B" or better, treated in accordance with Uniform Building
16 Code Standard 32.7 per City of Petaluma Ordinance 1744.

18 i. Provisions for annual weed/brush abatement is required for Lot 5, until it is
19 developed further. A plan that outlines the criteria for provisions of weed
20 abatement shall be developed. This plan shall be approved by the Fire
21 Marshal's office prior to approval of Final Map project.

23 11. Drainage design shall be in conformance with the Sonoma County Water Agency
24 Flood Control Design Criteria.
25
26 12. SPARC review of the Planned Unit Development Plan and Tentative Subdivision
27 Map shall be required prior to Final Map.
28
29 13. The following development fees shall be applicable to this project: water and sewer
30 connection, Community Facilities Development, Storm Dralnage Impact; Park and
31 Recreation Land Improvements, School Facilltles and Traffic Mitigation.

33 14. The applicant shall contact the County Special Assessments Department to
34 segregate the assessment lien for the proposed five- lots in the Sunnyslope
35 Assessment District (Contact Carol Kelm at 707/527-3220.
36
37 15. The improvemerit plans shall be prepared to shift the driveway to Lot 5 sufficiently
38 to avoid the dripline of the oak tree on the Lingle property (AP No. 019-460-005).
39 Hand-trenching shall be required within the dripline for storm drainage system or
40 other similar underground improvements. Rigid protective fencing shall be erected
41 5 feet from dripline of atl trees identified by the Planning Director prior to any
42 grading and/or construction activity on the site.
43 Under the power and authority conferred upon this Council by the Charter of said City.
