ReSOlUt10Cl ~O. 95-135 ~,C,S, • ~ of the City of Petaluma, California 1 z 3 4 5 6 7 8 RESOLUTION ADOPTING AN EXEMPTION TO CEQA 9 AND APPROVING CERTAIN AMENDMENTS TO THE 1 o GENERAL PLAN TEXT, 11 LAND USE MAP AND DEVELOPMENT CONSTRAINTS MAP 12 13 14 15 16 WHEREAS, the City Council adopted a new General Plan in March, 1987; and 17 18 WHEREAS, the adopted General Plan includes the statement "This plan shall be 19 comprehensively revdewed in 1992 to determine whether or not it is still in step with community 20 values and conditions"; and, 21 22 WHEREAS, the Planning Department, commenced the review in the summer of 1992 and 23 received direction from the City Council in January 1993 to conduct a public opinion survey 24 and hold public workshops to receive input; and 25 26 WHEREAS, the Planning Department, under contract with the Sonoma State University - 27 Institute for Community Planning Assistance, conducted a public opinion survey of Petaluma 28 citizens in the summer of 1993; and, 29 30 WHEREAS, the Planning Commission held public workshops to receive public testimony on 31 the need to amend the General Plan on July 15, August 19 and September 21, 1993; and, 32 33 WHEREAS, the Planning Commission conducted public hearings on various chapters of the 34 General Plan on January 19, .February 15, March 15 and April 19, 1994 to discuss various text 35 and map amendments; and, concluded their review at meetings held June 28 and July 12, 3 6 1994; and, 37 38 WHEREAS, the City Council held a public hearing on the amendment at its meeting of June 39 5, 1995 and considered all written and verbal communications pertaining to the matter before 4o rendering its decision. 41 aes-n~a.95-..1,35_......... s.cs. 1 NOW, THEREFORE, BE IT RESOLVED that the text and map amendments have been found 2 to be exempt from the requirements of the California Environmental Quality Act (CEQA) 3 pursuant to Sections 15061(b)(3), General Rule, 15305 (Minor Alterations in Land Use), and 4 15308-8 (Actions by Regulatory Agencies for the Protection of Natural Resources and the 5 Environment; and 6 7 BE IT FURTHER RESOLVED that in light of all information presented to the City Council, 8 both verbal and in writing, regarding the amendments, as set forth below, the Petaluma City 9 Council hereby makes [he following findings of fact: to it 1. Based on the information obtained through public workshops, public opinion surveys, 12 staff reports, research and expert testimony, the Planning Commission finds that the 13 General Plan is substantially still in step with community values and conditions, and 14 that these amendments are desired to better reflect community values and current 15 regulations. 16 2. That the Petaluma Growth Management System, applicable growth policies and limit of 17 500 building permits for residential units still serves the community. 18 3. The proposed amendments are deemed to be in the public interest. 19 4. The proposed General Plan amendments are consistent and compatible with the rest of 20 the General Plan and any implementation programs that may be affected. 21 5. The potential impacts of the proposed amendments have been assessed and have been 22 determined not to be detrimental to the public health, safety or welfare. 23 6. The proposed amendments have been processed in accordance with the applicable z4 provisions of the California Government Code. 25 7. The proposed amendments are exempt from the California Environmental Quality Act, 26 pursuant to Sections 15061(b)(3), General Rule, 15305 (Minor Alterations in Land 27 Use), and 15307-8 (Actions by Regulatory Agencies for the Protection of Natural 28 Resources and the Environment). 2 9 8. Staff is encouraged to amend the General Plan at their earliest convenience to remove 3 0 or modify programs that have already been implemented or to better reflect the .current 31 regulatory framework. 32 33 BE IT FURTHER RESOLVED that the Petaluma City Council hereby approves the proposed 34 amendments to the General Plan text, Land Use Map and Development Constraints Map, as 35 follows: 36 37 Reso. 95-135 NCS 2 1 TEXT AMENDMENTS: 2 3 COMMUNITY CHARACTER 4 5 1. Add Objective (page 16): 6 (g) Emphasize and encourage better integration of alternative transportation modes, 7 such as pedestrian and bicycle circulation, in street designs and improvements. 8 2. Add policies (page 16, 17): 9 Policy 15: Street improvements shall incorporate, where applicable, safe pedestrian 10 and bicycle access and related facilities. 11 Policy 16: New development shall include pedestrian and bicycle circulation within 12 and through the site to connect existing and/or planned City-wide 13 pedestrian and/or bicycle networks. 14 3. Add Ptograms (page 17): 15 Program 81: Where appropriate, intersection designs should include bicycle lanes 16 connecting through the intersections. 17 Program 9.2: Encourage use of street furniture, lighting, bicycle racks, transit 18 facilities, and landscaped areas within new development to enhance 19 pedestrian, transit and bicycle circulation. 20 4. Add Nature and Character of Development Objective (o), (page 19), by adding: 21 Encourage adaptive re-use of vacant or underutilized structures. 22 Re-letter existing Objectives "O" and "P" to "P" and "Q". 23 5. Add Policy (page 19): 24 Policy 16.2: Mixed use development is encouraged, particularly within the central 25 area. of the City. 26 6. Add Program (page 21)c 27 Program 37.2: Consider the creation of a City-wide Landscape Assessment 28 District to maintain arterial street landscaping, parks; and other public 2 9 landscaping and, amenities. 30 31 LAND USE AND GROWTH MANAGEMENT 32 33 1. Add Program (page 33): 34 Program 9: Develop additional zoning districts, similar to Riverfront Warehouse, 35 that promote mixed use and infill development, consistent with existing 3 6 General Plan policies and respectful of existing historic districts. Reso. 95-135 NCS 3 1 2. Delete Program 10 (page 33), calling for revision of Growth Management System to 2 make it more "workable"; revision was completed in 1987. 3 3. Add Program (page 33):. 4 Program 12: Calculate density for infill projects with a factor for previously dedicated 5 roadways to achieve better consistency and fairness between Zoning, and 6 General Plan regulations. 7 s OPEN SPACE, CONSERVATION AND ENERGY 9 l0 1. Add Program (page 53): 11 Program 33.I Work with Sonoma County Water Agency to review and modify creek 12 design and maintenance criteria to encourage natural channel habitat 13 while meeting flood capacity needs. 14 15 TRANSPORTATION 16 17 1. Amend Goa14 (page 99) to read: 18 Goal 4. Reduce dependence on the auto by integrating, to the extent feasible, 19 alternative transportation modes as a fundamental component of the z o City's transportation system: 21 2. Add Program (page 110): 22 Program 13.1: Major employment and commercial centers shall incorporate into 23 their development plans, to the extent possible, pedestrian, transit and 24 bicycle access, and related facilities such as bicycle racks/lockers, 25 pathways, street lighting and furniture, and transit stops. 26 3. Add Program (page 110): 27 Program ]3.2a Pedestrian links from commercial areas to neighboring residential 28 zones shall be encouraged. 29 4. Add Program (page 112): 3 0 Program 24.1: Designate and develop transit corridors along major arterials 31 (e. g., EastWashington Street, Petaluma Boulevard, Ely and McDowell 32 Boulevards), and improve them concurrent with major public 33 improvements with transit stops, bike paths and racks, and other 34 facilities, to serve and connect major employment, commercial and 3 5 activity centers. 36 37 Reso. 95-135 NCS 4 1 5. Add Policy (page 113): 2 Policy 32.1: Amend Zoning Ordinance to allow more flexibiliry in parking 3 requirements for mixed-use developments. 4 6. Add Program (page114): 5 Program 38.1: Allow flexibiliry in the application of street design and traffic 6 control standards where existing development patterns or natural 7 features make application of standards less than desirable or where strict S application of standards conflict with other General Plan policies (e. g., 9 peace and quiet in residential areas). 10 11 COMMUNITY HEALTH AND SAFETY lz 13 Add to Section 11.6, Slope Stability (page 120): 14 Program (15.1) Avoid development of areas highly susceptible to erosion and 15 sediment Zoss (e. g.: steep slopes) and require slope stabilization 16 measures where necessary. 17 Program (15.2) Require implementation of erosion and sedimentation controls in 18 the construction of all~new development. 19 Program (40) Encourage industrial use of reclaimed wastewater. 20 21 Add new Section (page 128): 2 2 11.13 MITIGATION MONITORING 23 Objective: 24 (u) Minimize significant adverse impacts on local environment through implementation and 25 monitoring of mitigation measures. 2 6 (v) Provide an adequate monitoring process for all adopted mitigation measures. 27 Program (40) Require new development to implement any required Mitigation 2 8 Monitoring Plan arul Biological Mitigation Plan to protect water quality 29 resources, prevent erosion and sedimentation, control sources of 3 0 pollutants and treat urban runoff 31 Program (41) Where applicable, develop an operation and maintenance program to 32 guarantee post-construction responsibility for on-site storm water quality 3 3 controls. 34 35 GLOSSARY 36 37 Amend definition of "Gateway" to further address architectural quality; as follows: Reso. 95-135 NCS 5 1 A-point-along-a-~©adway A roadway corridor where, upon entering the city, ai--vvl:ie-h a 2 motorist gains a sense of having left the envitons and of having entered the city. The intent of 3 the Gateway designation on the General Plan Land Use Map is to insure that these highly 4 visible developments and public improvements lee-atio>3 in the city may be appropriately treated 5 through superior design to give to the motorist a positive impression of this city, a sense of its 6 history, and/or its place in the natural environment. A gateway may be also include a publicly 7 owned place having--an-area .for motorists to pull off or park and view maps, gather 8 information, and generally become oriented to Petaluma; or it-tray--be-a privately-owned 9 places which through special development standards or guidelines (e.g., for landscaping and 10 signs), marks entry to the City; or a combination of both. 11 12 MAP AMENDMENTS: 13 14 LAND USE 15 1. Remove "proposed" designation on the following park/open space sites (the park/open 16 space has been improved and dedicated): 17 a. On Eagle Street between Cader Farms and Mountain Valley subdivisions. 18 b. Open space within Westridge Knolls off "I" Street. 19 2.
