AS 3 THEY RELATE TO THE COMPONENT OF SECONDARY EMERGENCY 4 VEHICLE ACCESS FOR THE COUNTRY CLUB ESTATES 2a/3a SUBDIVISION 5 6 7 WHEREAS, the City Council of Petaluma approved the Country Club Estates Unit s 2a/3a, PUD and Tentative Map through Resolutions #92-287, 92-299 and 92-300 in 9 November of 1992; and to 11 WHEREAS, the City Council imposed numerous conditions of approval and 12 mitigation measures as contained in the Resolutions of approval; and 13 14 WHEREAS, the City Council imposed mitigation measures and conditions of 15 approval requiring that secondary emergency access be provided for the 16 development of the subdivision; and 17 18 WHEREAS, the City Council determined after several public meetings on the topic, 19 that secondary emergency vehicle access is not readily available to the site in a 20 practical manner, and that such vehicle access raises significant environmental 21 issues and would be disruptive to the existing neighborhoods; and z2 23 WHEREAS, staff suggested that an alternate method be considered to address the 24 project's impacts to fire services; and 25 26 WHEREAS, the City Council, the applicant, and the general public were agreeable 27 to utilizing an alternate approach to address the project's impacts to fire services; 28 and 29 3 o WHEREAS, the City Council directed staff to amend the Resolutions pertaining to 31 the Country Club Estates 2a/3a subdivision to replace the requirement for the 32 construction of a secondary emergency vehicle access road with a cash contribution 33 by the developer equivalent to the estimated cost of the construction of the 34 secondary emergency access road ($300,000) for the purpose of allowing the City to 35 purchase a new fire engine equipped to address fire scenarios in an urban/wildland 3 6 interface. 37 1 Res. No.......95-130...... N.QS. 1 NOW THEREFORE BE IT RESOLVED that the City Council of the City of 2 Petaluma hereby finds as follows: 3 4 1. The City Council considered the environmental effects of the 5 development in conjunction with the approval of the subdivision 6 through the adoption of a mitigated negative declaration as reflected 7 in Resolution 92-287 N.C.S. Pursuant to section 15162 of the s California Environmental Quality Act (CEQA), no further 9 environmental review is required when a negative declaration has io been adopted unless significant amendment to the project is proposed 11 which causes new significant impacts. The alternative mitigation of 12 the project's impacts to fire services will serve to reduce the overall 13 impacts of the project upon fire services City-wide and will avoid 14 impacts which would have resulted from the original mitigation 15 measures (construction of the secondary emergency access road). 16 2. The provision of funds sufficient to purchase a fire engine will 17 mitigate the project's impacts to fire services in a manner such that 18 the secondary emergency vehicle access will not be required. 19 3. Resolution 92-287 N.C.S. which adopted the mitigated negative 2 o declaration for the Country Club Estates Units 2a/3a subdivision shall z i be amended as follows: 22 Mitigation measure #3.b.: Delete. 23 Mitigation measure #9.a.(1): The maximum grade of any street, 24 inelt}diog-the-ernergeney--aefess-~ro~; shall be no greater than 12%, 2 5 except with approval of the City engineer, grade may be increased to a 2 6 maximum of 15%. 27 Mitigation measure #9.a.(2): Delete. 2s Mitigation measure #9.a.(12): All open space areas shall be disked 29 around their perimeter to provide fire breaks. The open space areas 3 o shall also contain intersecting disked trails across--the--~ieldle to 31 discourage the rapid spread of fire. The existing jeep trail extending 32 along the ridge from the oak woodland in Lot 49 to the eucalyptus 33 windrow shall be graded and maintained to establish a functional and 34 operable ten foot wide fire break to the satisfaction of the Fire 35 Marshal. Such fire abatement practices shall be completed on an 36 annual basis and shall be subject to the review and approval of the , 2 Reso. 95-130 NCS 1 Fire Marshal. This service shall be funded through the Homeowner's 2 Association. 3 Mitigation measure #9.a.(15): The developer shall contribute 4 $300,000 to the City of Petaluma to pay all or a substantial portion of 5 the cost of a new fire engine. This contribution is an alternative to the 6 original requirement for an all weather secondary emergency access 7 road to protect the new homes within this subdivision from grassland 8 and hillside fires. The 33 lots within the remaining phases of this 9 development are subject to the payment of the contribution, to ($9,090.91 per lot). This contribution shall be recorded as a lien on 11 each lot in this subdivision with certain conditions of payment. 12 Payment of the contribution shall be made prior to the issuance of the 13 Certificate of Occupancy for each new home. The lien shall be 14 released by the City upon receipt of the payment. 15 4. Resolution 92-299 N.C.S. which adopted the PUD Development Standards 16 and the Design Guidelines for the Country Club Estates Unit 2a/3a 17 Subdivision shall be amended as follows: 18 Condition #7.h:: The PUD landscape plan referenced above shall 19 include the following items: The proposed location and details of the 2 o pedestrian access trail a-ncl-tl}eeu}e~~eac-y-~ec~s~-road in relation to 21 the trees. 22 5. Resolution 92-300 N.C.S. which approved the Tentative Subdivision map for 23 the Country Club Estates Unit 2a/3a Subdivision shall be amended as 2 4 follows: 25 Condition #4.r.: Delete. 26 Condition #S.f.: Delete. 27 2 $ resoccl/jm3 ~ 9 Under the power and authority conferred upon this Council by the Charter of said City.
