HomeMy WebLinkAboutResolution 95-116 05/15/1995 Resolution No. 95-116 N.C.S. of the City of Petaluma, California '1 2 3 A RESOLUTION APPROVING THE PLANNED UNIT DEVELOPMENT PLAN FOR 4 HOSPICE OF PETALUMA -ANEW ADMINISTRATIVE OFFICE FACILITY 5 INCLUDING ANCILLARY FACILITIES FOR INDIVIDUAL AND GROUP 6 COUNSELING LOCATED AT 416 PAYRAN STREET, APN 007-690-026 7 HOSPICE OF PETAL>3MA 8 WHEREAS, the Planning Commission held a public hearing to consider the project known 9 as Hospice of Petaluma on April 11, 1995, at which time the Commission recommended 10 that the City Council adopt a Mitigated Negative Declaration and approve the PUD 11 rezoning and PUD Development Plan; and 12 13 WHEREAS, the City Council at a public hearing held May 1, 1995, introduced Ordinance 14 No. 1979 N.C.S. approving the zoning map amendment rezoning the property to Planned 15 Unit District (PUD); adopted Resolution No.gS-110 N~Sopting a Mitigated Negative 16 Declaration pursuant to the California Environmental Quality Act (CEQA) for the 17 proposal. 18 19 NOW, THEREFORE, BE IT RESOLVED that this. Council hereby conditionally 20 approves the Planned Unit Development Plan as represented in the elevation drawings and 21 site plans received in the Planning Department on March 17, 1995, based on the following 22 findings and subject to the following conditions: 23 24 Findings for a PUD Development Plan: 25 26 1. The rezoning to PUD and the PUD Development Plan, as conditioned, results in a 27 more desirable use of the land and a better physical environment than would be 28 possible under the current M-L district or any single zoning district by appropriately 29 defining the principally permitted uses and the fairly unique ancillary/accessory uses 30 of Hospice, and allow for reduced setbacks for site and building improvements 31 necessary to accommodate the intensive site demands of the use. 32 33 2. The circulation pattern of the proposed PUD has been largely dictated by the 34 development of Payran Street and adjacent facilities, and has been designed to have 35 a suitable relationship to said circulation system. The existing circulation. system is 36 adequate to accommodate the additional traffic impacts generated from the 37 proposed development. 38 Reso. 95-116 NCS k~~,. rc~__........1__.........:.. ncs. 1 3. The plan for the proposed development, as conditioned, presents a unified and 2 organized arrangement. of buildings and site improvements which are appropriate in 3 relation to nearby properties. Adequate landscaping and screening will be reviewed 4 by SPARC to insure compatibility. 5 6 4. There are no significant scenic qualities of the site that warrant specific site design 7 alterations to insure their preservation. The plan will provide adequate available 8 outdoor/garden space as designated on the Development Plan. 9 10 5. The development of Hospice of Petaluma in the manner proposed by the applicant, 11 and as conditioned by the City will not be detrimental to the public welfare, will be 12 in the best interest of the City, and will be in kee ing with the general intent and 13 spirit of the zoning regulations and General Plan of~the City of Petaluma. 14 15 16 Conditions for PUD Development Plan: 17 18 1. The PUD Development Standards shall be subject to review and approval by 19 SPARC. The following information shall be incorporated into the Development 20 Standards, subject to staff review and approval prior to review by SPARC: 21 22 a. The Development Standards shall list the intended principally permitted 23 uses, accessory uses, and conditional uses. Additionally, based on proposed 24 and future uses, the standards shall establish minimum setbacks, maximum 25 building height,parking ratios, and landscaping standards. 26 27 2. The PUD Development Plan shall be referred to SPARC for review and approval. 28 SPARC's review shall include, but not be limited to the following: 29 30 a. The building(s) architecture including: building materials; fenestration; and 31 the design elements on the front, side and rear elevations. 32 b. A proposed color/material palette for roofs, building face and trim. 33 c. The master landscape plan for the public and private areas including the 34 location, variety, and size and quantity of plant material -with special 35 attention to measures that integrate a maximum of landscaping across the 36 sites street frontage. 37 d. Perimeter and interior fencing including the design of the arbor. 38 39 3. A reproducible (mylar or other) copy of the PUD Development Plan, and a copy of 40 the Development Standards including all necessary changes to said items required 41 by the City Council and/or SPARC shall be submitted to staff for review and 42 approval prior to issuance of a building permit. 43 44 4. All requirements from the Building Division shall be met, including: 45 46 a. Grading must be certified when completed to indicate compliance with 47 approved plans and will be required for occupancy. 48 b. Certify finish floor elevations before occupancy. 49 c. Soils with expansion index greater than 20 requires special design foundation 50 per Uniform Building Code 2904(b). 51 d. All roofing shall be "B" rated or betterper Ordinance No. 1744/1988. 52 e. Show site drainage and grading topography. 53 f. Indicate all utilities on site plan. 54 g. Responsible party to sign plans. Reso. 95-116 NCS 2 1 h. Submit soils report to verify foundation design. 2 i. Indicate group occupancy, type of construction, square footage. 3 j. Plans must show compliance to 1991 UBC, UPC, UMC, and 1990 NEC. 4 Plans must also show compliance to current Title 24 Energy Code. 5 k. Provide stnrctural calculations for all non-conventional destgn items. 6 1. Any portion of a building less then 20 feet from a property line must have 1 7 hour rating construction. 8 m. Handicapped parking must conform to handicapped van parking - 10 feet 9 wide stall plus an 8 foot walkway. 10 11 5. All requirements of the Engineering Department shall be met, including: 12 13 a. No construction shall occur in the existing easements except for pavement. 14 b. Obtain permission to construct a portion of the parking lot in the existing 15 easement from the Sonoma County Water Agency. 16 c. Show existing site improvements including: storm drains, manholes, drain 17 inlets, sewer lateral, water lateral, existing driveway approach, etc. This 18 information shall be shown on the future building perrmt application. New 19 driveway approaches shall be per City standards. If existing driveway 20 approach is not used it shall be removed and replaced with sidewalk. 21 d. Show drainage pattern for entire site with building permit application. No 22 lot to lot surface drainage is allowed. 23 24 6. All requirements from the Fire Marshal's office shall be met, including: 25 26 a. Fire flows for this complex shall be a minimum of 1500 GPM. 27 b. Provide a site map overview of Payran Street (to scale) indicating location of 28 nearest fire hydrant in relation to the project site. 29 c. An additional fire hydrant may be required based on location of existing 30 water supply on Payran Street. 31 d. Buildings larger than 3,500 sq.ft. in area or three stories or more in height 32 shall be protected by an automatic fire extinguishing system as required by 33 Section 10.507B of the 1991 Edition of the Uniform Fire Code. 34 e. Add as general note to building plans: 35 36 No combustible construction permitted above the foundation, unless 37 an approved all weather hard surface road is provided to within one- 38 hundred-fifty feet (150') of the furthest point of a building or 39 structure. 40 All fire hydrants for the project must be tested, flushed and in service 41 prior to combustible construction. 42 43 f. All roof covering material shall have a class "B" rating or better, treated in 44 accordance with the Uniform Building Code Standard 32.7 and City of 45 Petaluma Ordinance 1744. 46 g. All roof covering materials applied as exterior wail covering shall have a fire 47 rating of class "B", treated in accordance with Uniform Fire Code Standard 48 32.7 and City of Petaluma Ordinance 1744. 49 h. This plan has been reviewed with the information supplied. The plans may 50 be subject or will be subject to additional requirements as plans are revised. 51 52 7. The applicants/developers shall defend, indemnify, and hold harmless the City or 53 any of its boards, commission, agents, officers, and employees from any claim, action 54 or proceeding against the. City, its boards, commission, agents, officers, or employees Reso. 95-116 NCS 3 i to attack, set aside, void, or annul, the approval of the project when such claim or 2 action is brought within the time period provided form a plicable State and/or 3 local statutes. The City shall promptly notify the applicants developers of any such 4 claim, action, or proceeding. The Clty shall coordinate in the defense. Nothing 5 contained in this condition shall prohibit the City from participating in a defense of 6 any claim, action, or proceeding if the City bears its own attorney's fees and costs, 7 and the City defends the action In good faith. 8 9 10 11 12 HOSPUD/hg15 Under the power and authority conferred upon this Council by the Charter of said City.
