HomeMy WebLinkAboutResolution 95-110 05/01/1995 Resolution No. s5-IIO N.C.S. of the Citv of Petaluma, California 1 2 3 4 A RESOLUTION ADOPTING A MITIGATED NEGATIVE DECLARATION 5 PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) 6 AND CITY ENVIRONMENTAL REVIEW GUIDELINES FOR A ZONING MAP 7 AMENDMENT FROM LIGHT INDUSTRIAL (M-L) TO PLANNED UNIT DISTRICT 8 (PUD), AND A PUD DEVELOPMENT PLAN FOR HOSPICE OF PETALUMA FOR AN 9 ADMINISTRATIVE OFFICE FACILITY INCLUDING ANCILLARY FACILITIES FOR 10 INDIVIDUAL AND GROUP COUNSELING LOCATED AT 416 PAYRAN STREET, APN 11 007-690-026 12 HOSPICE OF PETALUMA 13 14 WHEREAS, the Planning Commission has considered at a public hearing held April 11, 15 1995, and recommended the adoption of a Mitigated Negative Declaration pursuant to the 16 California Environmental Quality Act (CEQA) and City Environmental Review 17 Guidelines in conjunction with the following actions: 18 19 1. Approval of a Zoning Map Amendment from M-L to PUD to permit the 20 development of an administrative office facility for Hospice of Petaluma with 21 ancillary facilities for individual and group counseling, and associated site 22 improvements on a vacant 21,000 sq.ft. parcel. 23 24 2. Conditional approval of a PUD Development Plan for the development of a 6,677 25 sq:ft. administrative office facility for Hospice of Petaluma with ancillary facilities 26 for individual and group counseling, and associated site improvements on a vacant 27 21,000 sq.ft. parcel. 28 29 NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council, in reference to 30 the impacts and mitigations identified in the initial study and as reflected in the 31 Commission's recommendations hereby adopts a Mitigated Negative Declaration for said 32 project based on the following findings, and subject to the following mitigation measures: 33 34 35 Findings for a Mitigated.Negative Declaration: 36 37 1. An Initial Study has been prepared and proper notice provided in accordance with 38 CEQA and local guidelines. 39 40 2. Based upon the Initial Study and comments received, potential impacts could be 41 avoided or reduced to a level of insignificance by miti~auon measures attached as 42 conditions of approval. There is no substantial evidence that the project, as 43 mitigated, will have a significant effect on the environment. 44 Reso. 95-110 NCS ass-n~..__._1___.__. h.cs. 1 3. A monitoring program has been included with the mitigations, where applicable, to 2 ensure compliance with the adopted mitigation measures. 3 4 4. The project does not have potential to affect wildlife resources as defined in the 5 Fish and Game code, either individually or cumulatively and is exempt -from Fish 6 and Game filing fees because there is no evidence that the proposed project would 7 have any potential for adverse effect on wildlife resources. 8 9 10 Mitigation Measures for PUD Development Plan: 11 12 1. During construction of this project, all grading and erosion control shall conform to 13 the City's Erosion Control Ordinance 15.76, subject to staff review and approval. 14 15 2. In the event that archaeological remains are encountered during grading, work shall 16 be halted temporarily and a qualified archaeologist shall be consulted for evaluation 17 of the artifacts and to recommend future action. The local Indian community shall 18 also be notified and consulted in the event any archaeological remains are 19 uncovered. 20 21 3. To offset the cumulative impacts this project is projected to create on the City's 22 services, the project proponent shall pay the following Special Development Fees 23 which are imposed on all like construction in the City of Petaluma: Sewer and 24 Water Connection, Community Facilities Development, Storm Drainage Impact, 25 School Facilities, and Traffic Mitigation. Timing for payment of all Spectal 26 Development Fees shall be as prescribed in the City's Spectal Development Fees 27 Handout. 28 29 4. Show drainage pattern for entire site with building permit application. No lot to lot 30 surface drainage is allowed. Proposed drainage tmprovements shall be subject. to 31 staff review and approval prior to tssuance of a building permit. 32 33 5. All storm drainage improvements proposed by this development shall conform to 34 the City and Sonoma County Water Agency requirements and the Petaluma Master 35 Drainage Plan prior to issuance of a butlding permit. 36 37 6. Construction activities shall comply with applicable Zoning Ordinance and 38 Municipal Code Performance Standards (noise, dust, and odor). Days and hours of 39 construction shall be limited to Monday through Friday between the .hours of 7:00 40 AM and 5:00 PM. No construction shall occur on Saturdays and Sundays or 41 holidays required by the City ofPetaluma. 42 43 7. An additional fire hydrant. may be required based on location of existing water 44 supply on Payran Street. 45 46 8. Buildings larger than 3,500 sq.ft. in area or three stories or more in height shall be 47 protected by an automatic fire extinguishing system as required by Sectton 10.507B 48 of the 1991 Edition of the Uniform Fire Code. 49 50 9. Add as general note to building plans: 51 52 No combustible construction permitted above the foundation, unless 53 an approved all weather hard surface road is provided to within one- Reso. 95-110 NCS 2 1 hundred-fifty feet (150') of the furthest point of a building or 2 structure. 3 r All fire hydrants for the project must be tested, flushed and in service 4 prior to combustible construction. 5 6 7 HOSPMTT/hg15 Under the power and authority conferred upon thin Council by the Charter of said City.
