2 DETERMINING THAT PUBLIC CONVENIENCE AND NECESSITY WOULD BE
3 SERVED BY THE ISSUANCE OF THREE ALCOHOLIC BEVERAGE CONTROL
4 LICENSES (IMPORTER, WHOLESALER, RETAILER) BY THE DEPARTMENT
5 OF ALCOHOLIC BEVERAGE CONTROL TO THE WINE LIBRARY AT 765
6 BAYWOOD DRIVE, SUITE 137, PETALUMA, APN 005-060-054

9 WHEREAS, in census tract areas known by the Department of Alcoholic Beverage
to Control (ABC) to have an undue concentration of on-sale and/or off-sale licenses, a
11 determination must be made by the local governing body that public convenience
1z and necessity would be served by the issuance of such ABC license(s); and

14 WHEREAS, on June 19, 1995, the City Council elected to make the public
15 convenience and necessity findings required by the Business and Professions Code
16 Section 23958.4; and
17
18 WHEREAS, Caroline and Edward Gelsman have applied to the City Council
19 requesting a determination be made that public convenience and necessity would be
20 served by the authorization of three ABC licenses (wine importer, wine wholesale,
21 wine retailer) for The Wine Library, proposed to be located at the Petaluma
22 Marina, 765 Baywood Drive, Suite 137, located in Census Tract #1506.04; and

24 WHEREAS, the request was heard on July 17, 1995 before the City Council at
25 which time information was heard and considered by the Council; and

27 NOW, THEREFORE, BE IT RESOLVED as follows, that it is hereby declared
28 that the City Council has found that public convenience and necessity would be
29 served by the issuance of three licenses (wine importer, wine wholesaler and wine
3o retailer) by the Department of Alcoholic Beverage Control to The Wine Library at
31 765 Baywood Drive, Suite 137, based on the following findings and subject to the
32 following conditions:

36 1. The proposed wine importing, wine wholesaling, and wine retailing business
37 known as The Wine Library at 765 Baywood Drive, Suite 137, Petaluma, as
3E conditioned, will conform to the requirements of the Petaluma Zoning
39 Ordinance and the Marina PCD Guidelines.

41 2. The proposed wine importing, wine wholesaling, and wine retailing business
42 known as The Wine Library at 765 Baywood Drive, Suite 137, Petaluma, as
43 conditioned, will not constitute a nuisance or be detrimental to the public
44 welfare of the community, as conditions have been imposed regarding the
45 hours of operation and location of business activities.

47 3. The proposed wine importing, wine wholesaling, and wine retailing business
4s known as The Wine Library at 765 Baywood Drive,.Suite 13Z, Petaluma, as
49 conditioned, will meet public convenience and necessity as the population
5o group from which the clientele will be dawn focuses mainly on retailers and
51 private collectors of fine and rare California and international wines.

53 4. The proposed wine importing, wine wholesaling, and wine retailing business

1 conditioned, will meet public convenience and necessity as there are no other
2 businesses within 1,000 feet of the applied for .premises which import,
3 wholesale, and retail old and rare California and international wines.

6 Conditions:

8 1. The Wine Library shall comply with all applicable provisions of The Marina
9 PCD guidelines, and ABC regulations.

11 2. The three licenses (wine importer, wine wholesaler, and wine retailer) are
12 the extent of the business activities for which the City Council will
13 recommend approval to the ABC. Application for other licenses to the ABC
14 shall require the Counci] to make a separate determination of public
15 convenience and necessity.

17 3. All business activities shall be confined to the interior of 765 Baywood Drive,
1s Suite 137. No parking lot sales, etc. shall be permitted.

2 0 4. Hours of operation when the business is open to the public shall be limited to
21 that proposed: Monday through Friday, 9AM to SPM. Office hours for staff
22 only shall be permitted 24 hours per day, 7 days per week, to facilitate
23 international business communications.
