Page 1 Resolution No. 2020-169 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING THE AWARD OF CONTRACT TO MIDSTATE BARRIER, INC. FOR THE HSIP VARIOUS SAFETY IMPROVEMENT PROJECT GUARDRAIL PROJECT C1610936 WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff prepared construction bid documents and solicited bids for the HSIP Various Safety Improvement Project guardrail project (Project); and WHEREAS, the project was bid on October 8, 2020 and two bids were received and opened on October 29, 2020 in accordance with applicable law; and WHEREAS, the lowest responsible bid for the Project was submitted by Midstate Barrier, Inc from Stockton CA, for $53,704; and WHEREAS, Midstate Barrier, Inc satisfies the bidding requirements for the Project; and WHEREAS #529261, that covers the work; and WHEREAS, the HSIP Various Safety Improvement Project Signal Upgrades is categorically the project consists of the repair, maintenance, and minor alteration of existing public facilities involving negligible or no expansion of existing or former use, including existing highways and streets, and the addition of safety or health protection devices for use in conjunction with existing facilities, in that the installation of guard rails will provide enhanced safety for motorists without expanding use of Petaluma Boulevard North. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: 1. Approves the revised project budget for the HSIP Various Safety Improvements Signal Upgrades. 2. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, waives any and all non-conformance in the bid of Midstate Barrier, Inc for the HSIP Signal Improvements Guardrail Project and finds the bid of $53,704 to be the lowest, responsive bid and further finds that Midstate Barrier, Inc, is the lowest responsible bidder. 3. Directs staff to issue a conditional notice of award to Midstate Barrier, Inc. 4. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma conditioned upon timely submission by Midstate Barrier, Inc, of the signed project contract and all other required document, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents.
