Page 1 Resolution No. 2020-172 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING PROGRAM ADMINISTRATION FEES FOR THE MOBILE HOME PARK SPACE RENT STABILIZATION PROGRAM FOR 2020 AND TEMPORARILY SUSPENDING IMPOSITION OF THE FEE DUE TO COVID-19 WHEREAS, in 1994, pursuant to Petaluma Municipal Code Chapter 6.50, the City of Petaluma adopted regulations comprising a Mobile Home Park Space Rent Stabilization Program; and WHEREAS, rent control regulations authorizes the City Council to adopt a Mobile Home Park Space Rent Stabilization Program administration fee annually by resolution or ordinance; and WHEREAS, the current Mobile Home Park Space Rent Stabilization Program administrative fee set ive fee fund is $95,475; and WHEREAS, a one- fees could ameliorate some of the impacts of the COVID-19 pandemic, including __________, on _______, by reducing costs otherwise borne by mobile home park owners and tenants, while still maintaining an administrative fee balance of approximately $77,000 available for potential future costs of rent arbitrations and other costs. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: 1. Suspends the current Mobile Home Park Space Rent Stabilization Program administration fee in the amount of sixty-five dollars ($65.00 otherwise chargeable as the mobile home park rent stabilization program administration defined in the Petaluma Municipal Code Section 6.50.060, including both occupied and to a rental agreement in full compliance with the requirements of Civil Code Section 798.1, subdivisions (a) and (b). This suspension shall be in effect from April 30, 2020 through April 29, 2021, at which time it will expire, without further action by the City Council. Effective as of April 30, 2021 [the suspension expiration date], unless otherwise amended by the City Council, the $65.00 administrative shall be reinstated and apply to each mobile home space not subject to a rental agreement in accordance with Civil Code Section 798.1 without further action of the City Council. 2. Directs that the staff forward notice explaining the one-time suspension of the Administration Fee park residents as a condition of the one-time suspension. Resolution No. 2020-172 N.C.S.
