HomeMy WebLinkAboutResolution 95-292 11/06/1995 `~°R~ Resolution No. 95-292 N.C.S. r of the City of Petaluma, California ESTABLISI~ING PETALUMA BOULEVARD NORTII BENEFIT DISTRICT 1 2 WHEREAS, in 1994, a new water main was constructed in Petaluma Boulevard North to 3 provide water to the Factory Outlet project; and 4 5 WHEREAS, during the construction period, seven water main stub-outs serving an area 6 containing sixteen Petaluma Boulevard North parcels 48-190-004, 48-190-005, 48-190-006, 48-200- 7 001, 48-200-002, 48-200-004, 48-200-005, 48-200-006, 48-200-007, 48-1.42-002, 48-142-003, 48- 8 142-004, 48-.142-005, 48-142-013, 48-142-014, 48-142-015 were provided; and 9 10 WHEREAS, Chapter 13.34 of tl~e Petaluma Municipal Code authorizes creation of benefit. 11 districts to permit the City to recoup such improvement costs; and 12 13 WHEREAS, Section 13.34.030 permits the establishment of such a district only after a public 14 hearing is .held; and 15 16 WHEREAS, State law requires that establishment of such a district also requires a public 17 meeting to be held prior to the public hearing; and 18 19 WHEREAS, said public meeting was held on October 19, 1995 and said public hearing was 20 held on November 6, 1995; 21 22 NOW, THEREFORE, BE IT RCSOLVED that the City Council hereby finds that: 1) the 23 proposed district and the improvements herein before noted are necessary for the promotion of the 24 public health, safety, and welfare and will benefit the properties within the district to a substantially 25 greater degree than the property of the public generally and will be necessary as a mitigation measure 26 to lessen substantially the environmental impacts caused by Nrc~ject development in such district and, 27 that 2) the adopted apportionment for-~nula will fairly apportion the benefits within the district, and 28 that 3) the imposition of the charges will not render the parcels in the district substantially valueless 29 for any private use. .Res. N.C.S. 1 2 NOW, THEREFORE, BE IT FURTHER RESOLVED that City Council does hereby 3 establish the Petaluma Boulevard North Benefit District consisting of the area included within the 4 above listed assessed parcels (see Exhibit A) and require reimbursement to the City of Petaluma in 5 the amount of $4,904.76 (see Exhibit B) for construction of water main stub-out improvements 6 (including City engineering/administrative overhead fee) at such time as future development or 7 redevelopment may occur on each individual parcel within the district which includes utilization of 8 the water main stub-out. Payment to be based on prorata share of stub-out capacity utilized by said 9 development or redevelopment. Under the power and authority conferred upon this Council by the Charter of said City.
