Page 1 Resolution No. 2021-029 N.C.S. of the City of Petaluma, California RESOLUTION TO APPROVE THE PROPOSED PROJECT LIST FOR FISCAL YEAR 21/22 PER THE REQUIREMENTS OF SENATE BILL 1 TO OBTAIN ROAD MAINTENANCE AND REHABILITATION ACCOUNT FUNDS WHEREAS, on April 28, 2017, the Governor signed Senate Bill 1 (SB1), which is known as the Road Repair and Accountability Act of 2017 to address basic road maintenance, rehabilitation, and critical safety needs on both the state highway and local streets and road system; and WHEREAS, in accordance with Streets and Highway Code, Section 2034, the City shall submit to the California Transportation Commission (Commission) a list of projects proposed to be funded with these funds pursuant to an adopted City budget, and projects proposed to receive funding shall be included in a City budget that is adopted by the City Council at a regular public meeting; and WHEREAS, SB 1 funding will enable the City to continue essential road maintenance and rehabilitation projects, safety improvements, and increase access and mobility options for the traveling public; and WHEREAS, a proposed project North McDowell Complete Streets to be submitted to the Commission has been compiled for the use of $2,462,000 made available by SB1 and supplemented by Street Maintenance Fund for the current fiscal year and due on May 1, 2021; and WHEREAS, Road Maintenance and Rehabilitation Account (RMRA) funds are categorically exempt pursuant to California Environmental Quality Act (“CEQA”) Title 14, of the California Code of Regulations Section 15301, because the project consists of the repair, maintenance, and minor alteration of existing public facilities involving negligible or no expansion of existing or former use, including existing highways and streets, and the mitigation of pavement conditions to enhance the safety for motorists and bicyclists; accordingly there are no cumulative impacts, unusual circumstances or other factors that would make the exemption inapplicable; and WHEREAS, the RMRA funds will be combined with the current Capital Improvement budget for the Pavement Restoration 21/22 project in the FY 21/22 CIP budget. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Declares the above recitals to be true and correct and are incorporated into the resolution as findings. 2. Road Maintenance and Rehabilitation Account (RMRA) funds are categorically exempt pursuant to California Environmental Quality Act (“CEQA”) Title 14, of the California Code of Regulations Section 15301, because the project consists of the repair, maintenance, and minor alteration of existing public facilities involving negligible or no expansion of existing or former use, including existing highways and streets, and the mitigation of pavement conditions to enhance the safety for motorists and bicyclists. Accordingly, there are no cumulative impacts, unusual circumstances or other factors that would make the exemption inapplicable. 3. Approves the proposed project, attached hereto as Exhibit A, for use of RMRA funding for FY 21/22. 4.
