Page 1 Resolution No. 2021-031 N.C.S. of the City of Petaluma, California RESOLUTION ACCEPTING COMPLETION OF THE TRAFFIC SIGNAL TIMING COMMUNICATION UPGRADES BY DC ELECTRIC GROUP INC. WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff prepared construction bid documents and solicited bids the Traffic Signal Timing Communication Upgrades (Project); and WHEREAS, the project was bid on May 7, 2019, and two (2) bids were received and opened on June 4, 2020 in accordance with applicable law; and WHEREAS, the lowest responsible bid for the Project was submitted by DC Electric Group, Inc. from Petaluma, CA for $69,770.00; and WHEREAS, by Resolution No. 2020-104 N.C.S., adopted on July 6, 2020, the City Council found the bid of $69,770.00 for the project to be the lowest responsive bid, awarded the Project to DC Electric Group Inc., conditioned on DC Electric Group Inc. timely execution of the project contract and submitting all required documents and authorized and directed the City Manager to sign the project contract on behalf of the City; and WHEREAS, the following contract change orders for in-field design alterations and supplemental flatwork within the project limits affecting the Project amount have been approved: Traffic Signal Timing Communication Upgrades Cost Change Order #1 $ 9,545 Total $ 9,545; and WHEREAS, the final contract amount as amended, including all change orders, overruns, and underruns is $79,315; and WHEREAS, when the City Council awarded this project on July 6, 2020, it found the proposed project consisting of traffic signal timing communication upgrades to be categorically exempt from the requirements of the California Environmental Quality Act (“CEQA”) in accordance with Section 15301(c) of the CEQA Guidelines as the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use because the communications upgrades to the traffic signals in the City consisted of repair and maintenance of existing traffic signals to improve pedestrian and vehicle safety without otherwise affecting the intersections’ use, and therefore negligible or no expansion of use beyond what currently exists and there is no cumulative impacts, unusual circumstances or other factors that would make the exemption inapplicable; and WHEREAS, based on the foregoing, staff recommends acceptance of the project on behalf of the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: 1. The above recitals are hereby declared to be true and correct and are incorporated into this resolution as findings of the City Council. When the City Council awarded this project on July 6, 2020, it found the proposed project consisting of traffic signal timing communication upgrades to be categorically exempt from the requirements of the California Environmental Quality Act (“CEQA”) in accordance with Section 15301(c) of the CEQA Guidelines as the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The communications upgrades to the traffic signals in the City consisted of repair and maintenance of existing traffic signals to improve pedestrian and vehicle safety without otherwise affecting the intersections’ use. Accordingly, there is negligible or no expansion of use beyond what currently exists and there is no cumulative impacts, unusual circumstances or other factors that would make the exemption inapplicable. 3. The contract titled Traffic Signal Timing Communication Upgrades, project no. C16102140, with the final contract amount of $79,315, is accepted as complete, subject to the Contractor’s continuing warranty and other obligations pursuant to the contract. 4. The City Clerk is hereby authorized and directed to file a Notice of Completion in compliance with the California Civil Code concerning the project with the Sonoma County Clerk’s Office within ten (10) days of the date of this Resolution. 5. Staff are hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the project contract, California Public Contract Code Section 7107, and applicable law. 6. Authorizes staff to prepare a budget adjustment for the CIP project as outlined in the Financial Impact Section. Under the power and authority conferred upon this Council by the Charter of said City.
