Resolution No. 2021-032 N.C.S.
of the City of Petaluma, California
RESOLUTION ACCEPTING THE COMPLETION OF THE CITY-WIDE STRIPING
BY BAYSIDE STRIPE AND SEAL, INC.
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162 and other applicable law, City staff prepared construction bid documents and
solicited bids the City-Wide Striping (Project); and
WHEREAS, the project was bid on June 29, 2020, and six (6) bids were received and opened on June 4,
2020 in accordance with applicable law; and Bayside Stripe and Seal, Inc. from Petaluma, CA submitted the
lowest responsive bid in the amount of $63,269; and
WHEREAS, staff determined Bayside Stripe and Seal to be a responsible bidder in possession of a
valid Class C-32 California Contractor’s License, #883985, which is appropriate for the project work; and
WHEREAS, by Resolution No. 2020-138 N.C.S., adopted on September 14th, 2020, the City Council found
the bid of $63,269 for the project to be the lowest responsive bid, awarded the Project to Bayside Stripe and
Seal, Inc., conditioned on Bayside Stripe and Seal, Inc. timely execution of the project contract and submitting
all required documents and authorized and directed the City Manager to sign the project contract on behalf of
the City; and
WHEREAS, the following contract change orders for in-field design alterations and supplemental flatwork
within the project limits affecting the Project amount have been approved:
City-Wide Striping Cost
Change Order #1 $ 10,804
Total $ 10,804;
and
WHEREAS, the final contract amount as amended, including all change orders, overruns, and underruns is
$66,744.50; and
WHEREAS, when the City Council awarded this project on September 14, 2020, it found the proposed
project consisting of installing thermoplastic markings on higher volume intersections and upgrading
crosswalks to be categorically exempt from the requirements of the California Environmental Quality Act
(“CEQA”) in accordance with Section 15301(c) of the CEQA Guidelines as the operation, repair, maintenance,
permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical
equipment, or topographical features, involving negligible or no expansion of existing or former use, because
the City-wide striping work to refresh and update crosswalks at high volume intersections in the City consisted
of repair and maintenance of existing intersection and cross walk markings to make the markings more visible
and improve pedestrian safety without otherwise affecting the intersections’ use, and therefore negligible or no
expansion of use beyond what currently exists and no cumulative impacts, unusual circumstances or other
factors resulted from the project award that would make the exemption inapplicable; and
WHEREAS, based on the foregoing, staff recommends acceptance of the project on behalf of the City.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows:
1. The above recitals are hereby declared to be true and correct and are incorporated into this resolution as
findings of the City Council.
2. When the City Council awarded this project on September 14, 2020, it found the proposed project consisting
of installing thermoplastic markings on higher volume intersections and upgrading crosswalks to be
categorically exempt from the requirements of the California Environmental Quality Act (“CEQA”) in
accordance with Section 15301(c) of the CEQA Guidelines as the operation, repair, maintenance,
permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities,
mechanical equipment, or topographical features, involving negligible or no expansion of existing or former
use. The City-wide striping work to refresh and update crosswalks at high volume intersections in the City
consisted of repair and maintenance of existing intersection and cross walk markings to make the markings
more visible and improve pedestrian safety without otherwise affecting the intersections’ use. Accordingly,
there is negligible or no expansion of use beyond what currently exists and there is no cumulative impacts,
unusual circumstances or other factors that would make the exemption inapplicable.
3. The contract titled Traffic City-Wide Striping, project no. E16102130, with the final contract amount of
$66,744.50, is accepted as complete, subject to the Contractor’s continuing warranty and other obligations
pursuant to the contract.
4. The City Clerk is hereby authorized and directed to file a Notice of Completion concerning the project with
the Sonoma County Clerk’s Office within ten (10) days of the date of this Resolution.
5. Staff are hereby authorized and directed to release all undisputed retention not subject to pending change
orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the project
contract, California Public Contract Code Section 7107, and applicable law.
Under the power and authority conferred upon this Council by the Charter of said City.
REFERENCE: I hereby certify the foregoing Resolution was introduced and adopted by the
Council of the City of Petaluma at a Regular meeting on the 15th day of March
2021, by the following vote:
