Resolution No. 2021-033 N.C.S.
of the City of Petaluma, California
RESOLUTION ACCEPTING COMPLETION OF THE CONTRACT FOR THE HSIP VARIOUS
SAFETY IMPROVEMENT PROJECT – GUARDRAIL PROJECT BY MIDSTATE BARRIER, INC.
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162 and other applicable law, staff prepared construction bid documents and solicited
bids for the HSIP Various Safety Improvement Project – guardrail project (Project); and
WHEREAS, the project was bid on October 8, 2020 and two bids were received and opened on October 29,
2020 in accordance with applicable law; and
WHEREAS, the lowest responsible bid for the Project was submitted by Midstate Barrier, Inc. from
Stockton, CA for $53,704; and
WHEREAS, by Resolution No. 2020-169 N.C.S., adopted on December 7, 2020, the City Council found
the bid of $53,704 for the project to be the lowest responsive bid, awarded the Project to Midstate Barrier, Inc.,
conditioned on Midstate Barrier, Inc. timely execution of the project contract and submitting all required
documents and authorized and directed the City Manager to sign the project contract on behalf of the City; and
WHEREAS, the final contract amount as amended, including all change orders, overruns, and underruns is
$43,520; and
WHEREAS, when the City Council awarded this project on December 7, 2020, it found the proposed
project consisting of installing new guardrails to be categorically exempt pursuant to California Environmental
Quality Act (“CEQA”) and Title 14, the California Code of Regulations (“CEQA Guidelines”), Section
15301(c), because the project consists of the repair, maintenance, and minor alteration of existing public
facilities involving negligible or no expansion of existing or former use, including existing highways and
streets, and the addition of safety or health protection devices for use in conjunction with existing facilities, in
that the installation of guardrails will provide enhanced safety for motorists without expanding use of Petaluma
Boulevard North, and therefore negligible or no expansion of use beyond what currently exists and there are no
cumulative impacts, unusual circumstances or other factors that would make the exemption inapplicable; and
WHEREAS, based on the foregoing, staff recommends acceptance of the project on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows:
1. The above recitals are hereby declared to be true and correct and are incorporated into this resolution as
findings of the City Council.
2. When the City Council awarded this project on December 7, 2020, it found the proposed project consisting
of installing new guardrails to be categorically exempt pursuant to California Environmental Quality Act
(“CEQA”) and Title 14, the California Code of Regulations (“CEQA Guidelines”), Section 15301(c),
because the project consists of the repair, maintenance, and minor alteration of existing public facilities
involving negligible or no expansion of existing or former use, including existing highways and streets, and
the addition of safety or health protection devices for use in conjunction with existing facilities, in that the
installation of guardrails will provide enhanced safety for motorists without expanding use of Petaluma

Boulevard North. Accordingly, there are no negligible or no expansion of use beyond what currently exists
and there are no cumulative impacts, unusual circumstances or other factors that would make the exemption
inapplicable.
3. The contract titled Traffic Signal Timing Communication Upgrades, project no. C1610936, with the final
contract amount of $43,520 is accepted as complete, subject to the Contractor’s continuing warranty and
other obligations pursuant to the contract.
4. The City Clerk is hereby authorized and directed to file a Notice of Completion concerning the project with
the Sonoma County Clerk’s Office within ten (10) days of the date of this Resolution.
5. Staff are hereby authorized and directed to release all undisputed retention not subject to pending change
orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the project
contract, California Public Contract Code Section 7107, and applicable law.
6. Authorizes staff to prepare a budget adjustment for the CIP project as outlined in the Financial Impact
Section.
Under the power and authority conferred upon this Council by the Charter of said City.

Council of the City of Petaluma at a Regular meeting on the 15th day of March
