Page 1 Resolution No. 2021-038 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING THE EXECUTION OF A PROFESSIONAL SERVICES AGREEMENT FOR DESIGN AND ENGINEERING SERVICES FOR THE NORTH MCDOWELL BOULEVARD COMPLETE STREETS PROJECT TO RECONSTRUCT THE ROADWAY AND PROVIDE PEDESTRIAN AND BIKEWAY IMPROVEMENTS, SIGNAGE AND SIGNALIZATION WHEREAS, the City of Petaluma intends to evaluate and prepare a design for the North McDowell Blvd. Complete Streets project; and WHEREAS, the construction of North McDowell Boulevard Complete Streets project will better accommodate motor vehicle traffic and will provide safer conditions for pedestrians and bicyclists; and WHEREAS, the City intends to initiate design, engineering, and cost estimates for the project, which requires the services of a qualified professional engineering firm familiar with such projects and experienced in Complete Streets design; and WHEREAS, a Request for Proposal was prepared and circulated for Professional Engineering and Design Services for the North McDowell Boulevard Complete Streets Project No. C16102139; and WHEREAS, four proposals were received on December 10, 2020, and opened and reviewed in accordance with applicable law; and WHEREAS, an internal selection committee recommended BKF Engineers as the most qualified firm to conduct professional engineering and design services for the North McDowell Blvd. Complete Streets project; and WHEREAS, BKF Engineers, has significant expertise in all areas of roadway reconstruction design and has completed recent comparable work in Marin and Sonoma County; and WHEREAS, the recommended proposal submitted by BKF Engineers from Santa Rosa, CA, is for an amount not to exceed $396,139. WHEREAS, the BFK Engineers proposal was responsive, and no protests have been received concerning the BFK Engineers proposal and the time to protest the proposal has lapsed; and WHEREAS, this project is categorically exempt pursuant to the California Environmental Quality Act (“CEQA”) pursuant to Article 19, Section 15301(c), of Title 14 of the California Code of Regulations (“CEQA Guidelines”), because the project consists of the repair, maintenance, and minor alteration of existing public facilities involving negligible or no expansion of existing or former use, including sidewalks and gutters as the sidewalk, curb ramp and related improvements will repair and maintain existing pedestrian travel ways and related facilities without changing the use of those facilities; accordingly, there is negligible or no expansion of use beyond what currently exists and there no cumulative impacts, unusual circumstances, or other factors that would make the exemption inapplicable pursuant to CEQA Guidelines section 15300.2. The above recitals are hereby declared to be true and correct and are incorporated into this resolution as findings of the City Council. 2. This project is categorically exempt pursuant to the California Environmental Quality Act (“CEQA”) pursuant to Article 19, Section 15301(c), of Title 14 of the California Code of Regulations (“CEQA Guidelines”), because the project consists of the repair, maintenance, and minor alteration of existing public facilities involving negligible or no expansion of existing or former use, including sidewalks and gutters. The sidewalk, curb ramp and related improvements will repair and maintain existing pedestrian travel ways and related facilities without changing the use of those facilities. Accordingly, there is negligible or no expansion of use beyond what currently exists and there no cumulative impacts, unusual circumstances, or other factors that would make the exemption inapplicable pursuant to CEQA Guidelines section 15300.2. 3. The City Manager is hereby authorized and directed to execute a Professional Services Agreement (PSA) for professional engineering and design services with BKF Engineers, in support of the North McDowell Blvd. Complete Streets project in the amount not to exceed $396,139. Under the power and authority conferred upon this Council by the Charter of said City.
