Resolution No. 2021-047 N.C.S.
of the City of Petaluma, California
RESOLUTION AUTHORIZING AWARD OF A PROFESSIONAL SERVICES AGREEMENT TO
BARTLE WELLS ASSOCIATES FOR THE 2022 WATER AND SEWER RATE STUDY
WHEREAS, the City of Petaluma wishes to complete a water and sewer rate study; and
WHEREAS, Government Code section 53756, requires the City to prepare a new rate study and adopt new
rates every five years if it wishes to rely on automatic cost adjustments; and
WHEREAS, the City requires the specialized knowledge of a municipal financial consultant to complete the
rate study in compliance with the requirements of State Proposition 218; and
WHEREAS, the City of Petaluma requested proposals from two (2) consultants; and
WHEREAS, Bartle Wells Associates was selected for their responsiveness and ability to produce quality work
as demonstrated in previous rate studies conducted for the City and other agencies; and
WHEREAS, staff recommends the City execute a professional services agreement with Bartle Wells
Associates in order to complete the 2022 Water and Sewer Rate Study; and
WHEREAS, once the 2022 Water and Sewer Rate Study is complete staff will present to recommendations
to Council, followed by the Proposition 218 Public Hearing; and
WHEREAS, the proposed action is exempt from the requirements of the California Environmental Quality
Act (CEQA) in accordance with CEQA Guidelines Section 15378, as authorizing an award of a Professional
Services Agreement to a vendor to conduct a Water & Sewer Rate Study does not meet CEQA's definition of a
“project,” because the action does not have the potential for resulting either a direct physical change in the
environment or a reasonably foreseeable indirect physical change in the environment, and because the action
constitutes organizational or administrative activities of governments that will not result in direct or indirect
physical changes in the environment; or alternatively, if the proposed action did constitute a project, this action
is exempt under the feasibility and planning studies exemption, CEQA Guidelines Section 15262 as this is a study
for future sewer and water rates and there are no cumulative impacts, unusual circumstances, or other factors that
would make the exemption inapplicable pursuant to CEQA Guidelines section 15300.2.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby:
1. The above recitals are hereby declared to be true and correct and are incorporated into this resolution as
findings of the City Council.
2. Finds the proposed action is exempt from the requirements of the California Environmental Quality Act
(CEQA) in accordance with CEQA Guidelines Section 15378, as authorizing an award of a Professional
Services Agreement to a vendor to conduct a Water & Sewer Rate Study does not meet CEQA's definition
of a “project,” because the action does not have the potential for resulting either a direct physical change
in the environment or a reasonably foreseeable indirect physical change in the environment, and because
the action constitutes organizational or administrative activities of governments that will not result in
direct or indirect physical changes in the environment. Alternatively, if the proposed action did constitute

3. Authorizes the City Manager to execute the attached Professional Services Agreement for the 2022 Water
& Sewer Rate Study with Bartle Wells Associates in an amount not to exceed $59,850.
Under the power and authority conferred upon this Council by the Charter of said City.
REFERENCE: I hereby certify the foregoing Resolution was introduced and adopted by the
Council of the City of Petaluma at a Regular meeting on the 19th day of April
