RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 2 TO
THE MEASURE M COOPERATIVE FUNDING AGREEMENT M70604 BETWEEN THE SONOMA
COUNTY TRANSPORTATION AUTHORITY AND THE CITY PETALUMA
WHEREAS, Sonoma County Transportation Authority (SCTA) and the City of Petaluma entered into a
cooperative funding agreement on May 1, 2006 to enable two parties to work cooperatively in allocating
funding for the Petaluma River Trail project as described in the 2005 Strategic Plan; and
WHEREAS, the City completed phase I, II and III of the Petaluma River Trail Project; and
WHEREAS, SCTA adopted the 2017 Strategic Plan, which updated the project implementation policies
with regard to the use of funds; and
WHEREAS, the City requested advancement of the design funds of $32,000 to start phase IV; and
WHEREAS, the City Council approved amendment No. 1 which amended the existing agreement to
include the updated contact information, and the revisions to the 2017 strategic plan, project plan, financial
plan, and schedule for the completion of phase IV of the Petaluma River Trail project; and
WHEREAS, the City conditioned a reimbursement agreement with the Spanos Group as part of the North
River Apartment development project as required on condition of approvals item 37 for the entitlements phase;
and
WHEREAS, the City Council approval for amendment No.2 to the agreement allows the City to construct
the Petaluma River Trail project that is funded by Measure M and allows reimbursement for the construction
work performed on phase IV of the Petaluma River Trail Project, and
WHEREAS, adopting a resolution to amend a funding agreement does not constitute a “project” under the
California Environmental Quality Act (CEQA) Guidelines Section 15378 as this is an administrative activity
that will not result in direct or indirect physical changes in the environment, and that the Petaluma River Trail
Project, which the funding agreement is funding, was previously analyzed under CEQA with a mitigated
negative declaration, state clearinghouse number 2004122121.
NOW THEREFORE, BE IT RESOLVED, that the Petaluma City Council hereby:
1. Finds the above recitals are hereby declared to be true and correct and are incorporated into this ordinance
as findings of the City Council.
2. Finds that adopting a resolution to amend a funding agreement does not constitute a “project” under the
California Environmental Quality Act (CEQA) Guidelines Section 15378 as this is an administrative
activity that will not result in direct or indirect physical changes in the environment. And that the Petaluma
River Trail Project, which the funding agreement is funding, was previously analyzed under CEQA with a
mitigated negative declaration, state clearinghouse number 2004122121.
3. Authorizes the City Manager to execute Amendment No. 2 to the Measure M Cooperative Funding
Agreement M70604 between the City of Petaluma and Sonoma County Transportation Authority.

REFERENCE: I hereby certify the foregoing Resolution was introduced and adopted by the
Council of the City of Petaluma at a Regular meeting on the 17th day of May 2021,
