Resolution No. 2021-075 N.C.S.
of the City of Petaluma, California
RESOLUTION ACCEPTING BIDS AND AWARDING CONTRACTS TO THE LOWEST
RESPONSIBLE BIDDERS FOR FURNISHING CHEMICALS FOR WASTEWATER TREATMENT
FOR FISCAL YEAR 21/22 AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE
NECESSARY AGREEMENTS OR PURCHASE ORDERS
WHEREAS, the City uses bulk chemicals in its operation of the Ellis Creek Water Recycling Facility; and
WHEREAS, the City joined the North Bay Agency Chemical Pool (NBACP) in 2009 to obtain lowest
possible pricing through joint purchasing; and
WHEREAS, the NBACP conducted a competitive bid process for chemicals commonly used at water and
wastewater treatment facilities; and
WHEREAS, the NBACP issued an Invitation to Bid on April 7, 2021, and eleven (11) bids were received
and opened on May 5, 2021, in accordance with applicable law; and
WHEREAS, the City conducted a competitive bid process for specialty chemicals used at the Ellis Creek
Water Recycling Facility; and
WHEREAS, the City issued an Invitation to Bid on April 1, 2021, and two bids were received and opened
on May 6, 2021, in accordance with applicable law; and
WHEREAS, the lowest responsive bidders for the chemicals to be purchased through the NBACP were:
1. Univar USA, Inc. for Sodium Hypochlorite
2. Univar USA, Inc. for Sodium Bisulfite
3. Pennco for Ferric Chloride; and
WHEREAS, the lowest responsive bidders for the specialty chemicals bid by the City of Petaluma were
1. USALCO for Aluminum Chlorohydrate or equivalent
2. SNF/Polydyne Inc. for C-6288 polymer or equivalent (solids thickening)
3. SNF/Polydyne Inc. for WE-1152 polymer or equivalent (solids dewatering); and
WHEREAS, the time to challenge these bids has lapsed; and
WHEREAS, as a member of NBACP, the City of Petaluma is entitled to purchase bulk chemicals from the
NBACP’s low bidders at the bid price stated; and
WHEREAS, the bulk chemical purchases bid by the NBACP satisfies the purchasing requirements of
Petaluma Municipal Code Chapter 4.04 pursuant to Petaluma Municipal Code Section 4.04.100, “Cooperative
Purchasing Programs;” and
WHEREAS, the annual purchasing of chemicals in compliance with the City’s National Pollutant Discharge
Elimination Service permit is categorically exempt from further review of the California Environmental Quality
Act (CEQA) pursuant to Guidelines Section 15301 (Existing Facilities) which exempts the operation, repair,
maintenance, or minor alteration of existing public or private structures, facilities, mechanical equipment or
topographic features involving negligible or no expansion of use beyond that previously existing and the
purchasing of chemicals to treat wastewater is exempt pursuant to CEQA Guidelines Section 15307 (Actions by

a regulatory agency for protection of natural resources) and there are no cumulative impacts, unusual
circumstances or other factors that would make these exemptions inapplicable pursuant to CEQA Guidelines
section 15300.2.
WHEREAS, the City Council budgeted funds in Fiscal Year 21/22 to purchase chemicals used at the Ellis
Creek Water Recycling Facility.
NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Petaluma hereby:
1. Declares the above recitals are hereby declared to be true and correct and are incorporated into this resolution
as findings of the City Council.
2. Finds the annual purchasing of chemicals in compliance with the City’s National Pollutant Discharge
Elimination Service permit is categorically exempt from further review of the California Environmental
Quality Act (CEQA) pursuant to Guidelines Section 15301 (Existing Facilities) which exempts the operation,
repair, maintenance, or minor alteration of existing public or private structures, facilities, mechanical
equipment or topographic features involving negligible or no expansion of use beyond that previously existing
and the purchasing of chemicals to treat wastewater is exempt pursuant to CEQA Guidelines Section 15307
(Actions by a regulatory agency for protection of natural resources) and there are no cumulative impacts,
unusual circumstances or other factors that would make these exemptions inapplicable pursuant to CEQA
Guidelines section 15300.2.
3. Authorizes the City Manager to award bids and execute all necessary documents with the following vendors
for the purchase of chemicals listed below for fiscal year 21/22:
1. Univar USA, Inc. for Sodium Hypochlorite (12.5%), $0.6586/gallon plus applicable sales tax, not to
exceed $144,233.40.
2. Univar USA, Inc. for Sodium Bisulfite, $1.295/gallon plus applicable sales tax, and not to exceed
$56,800.00 .
3. Pennco for Ferric Chloride (43%), $900.00/dry ton plus applicable sales tax, and not to exceed
$108,405.00.
4. USALCO for Aluminum Chlorohydrate, $0.267/gallon, and not to exceed $26,166.00.
5. SNF/Polydyne Inc. for C-6288 Polymer or equivalent, $12.565/gallon, and not to exceed $23,747.85.
6. SNF/Polydyne Inc. for WE-1152 Polymer or equivalent, $12.565/gallon, and not to exceed $326,690.
Under the power and authority conferred upon this Council by the Charter of said City.
REFERENCE: I hereby certify the foregoing Resolution was introduced and adopted by the
Council of the City of Petaluma at a Regular meeting on the 7th day of June 2021,
