Resolution No. 2021-081 N.C.S.
of the City of Petaluma, California
RESOLUTION APPROVING FIXED AND OBSERVED HOLIDAYS FOR FISCAL YEAR 2021/2022
WHEREAS, the City provides twelve paid holidays and one floating or personal leave holiday to employees
annually as designated in each Memoranda of Understanding (MOU) and Compensation Plan; and,
WHEREAS, the MOUs and Compensation Plan for each unit specify the fixed and observed holidays for
that unit; and,
WHEREAS, a fixed holiday is the actual holiday the City has agreed to recognize and the observed holiday
is the date the fixed holiday will be observed and employees provided the day off; and,
WHEREAS, on October 5, 2020, the City Council approved an amendment to the City’s FY 2020/2021
holiday schedule which replaced Columbus Day with an additional floating holiday; and,
WHEREAS, Government Code Section 6717 which states that the Governor shall annually proclaim March
31 as “Cesar Chavez Day;” and,
WHEREAS, the proposed action is exempt from the requirements of the California Environmental Quality
Act (CEQA) in accordance with CEQA Guidelines Section 15378, in that approving the City’s fixed observed
holidays for fiscal year 2021-2022 does not meet CEQA's definition of a “project,” because the action constitutes
a government organizational or administrative activity which does not have the potential for resulting in either a
direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment
as the resolution replaces a previously observed holiday to a different date; and,
WHEREAS, if the proposed action did constitute a project under CEQA the action is exempt under the
common-sense exemption, CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there
is no possibility that the proposed action could have a significant impact on the environment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows:
1. Declares the above recitals to be true and correct and are incorporated into this resolution as findings of the
City Council.
2. Finds the proposed action is exempt from the requirements of the California Environmental Quality Act
(CEQA) in accordance with CEQA Guidelines Section 15378, in that approving the City’s fixed observed
holidays for fiscal year 2021-2022 does not meet CEQA's definition of a “project,” because the action
constitutes a government organizational or administrative activity which does not have the potential for
resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical
change in the environment as the resolution replaces a previously observed holiday to a different date, and
relatedly, if the proposed action did constitute a project under CEQA the action is exempt under the common-
sense exemption, CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no
possibility that the proposed action could have a significant impact on the environment.
3. Orders that Columbus Day is formally replaced with Cesar Chavez Day.

4. The twelve, designated fixed and observed holidays for the employees of the City of Petaluma for FY
2021/2022 shall be as follows:
