Page 1 Resolution No. 2021-084 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING A LETTER OF SUPPORT FOR SB 612 (PORTANTINO) WHEREAS, on December 4, 2012, the County of Sonoma and the Sonoma County Water Agency approved a Joint Powers Agreement creating the Sonoma Clean Power Authority “the Authority” and under the Joint Powers Agreement, cities and towns within Sonoma County may participate in the Sonoma Clean Power Community Choice Aggregation program by adoption of a resolution and ordinance required by Public Utilities Code 366.2; and WHEREAS, on December 15, 2014, the City adopted Resolution 2014-198 N.C.S. requesting that the Sonoma Clean Power Authority act as a Community Choice Aggregator on behalf of the City and implement the Sonoma Clean Power Community Choice Aggregation program within the city of Petaluma; and WHEREAS, on January 5, 2015, the City adopted Ordinance 2525 N.C.S. authorizing the implementation of a Community Choice Aggregation program; and WHEREAS, the City pays a Power Charge Indifference Adjustment as a result of participation in Sonoma Clean Power electrical generation programs; and WHEREAS, neither the City, nor its ratepayers, receive a direct benefit from the payment of Power Charge Indifference Adjustment charges; and WHEREAS, SB 612 would allow Community Choice Aggregation programs to realize direct benefits of legacy electrical agreements secured by Investor-Owned Utilities, potentially decreasing PCIA charges which would benefit ratepayers within the city of Petaluma; and WHEREAS, adoption of this Resolution is exempt under the “common sense” exception in CEQA Guidelines Section 15061(b)(3), as it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby finds the above recitals to be true and correct and are incorporated herein as findings of this Resolution, approves of a Letter of Support for SB 612, and directs staff to submit the Letter of Support to the California Assembly for consideration. Under the power and authority conferred upon this Council by the Charter of said City.
