Page 1 Resolution No. 2021-097 N.C.S. of the City of Petaluma, California RESOLUTION APPROVING THE AGREEMENT BETWEEN THE CITY OF PETALUMA AND THE SONOMA COUNTY COMMUNITY DEVELOPMENT COMMISSION REGARDING THE HOMELESS EMERGENCY AID PROGRAM (HEAP) WHEREAS, the City applied to the Sonoma County Community Development Commission for Homeless Emergency Aid Program (HEAP) funds; and WHEREAS the Sonoma County Community Development Commission, Continuum of Care Committee awarded a grant of HEAP funds in the amount of $45,000 to the City for the purchase of the Petaluma CAHOOTS program Van; and WHEREAS the Sonoma County Community Development Commission, Continuum of Care Committee awarded a grant of HEAP funds in the amount of $50,000 to the City for the purchase of a Pick-Up Truck for the Downtown Streets Team; and WHEREAS, the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, in that approving the contract between The County of Sonoma Community Development Commission for the Homeless Emergency Aid Program (HEAP) and authorizing the City Manager to execute all contracts related to the HEAP funding Agreement does not meet CEQA's definition of a “project,” because the action does not have the potential for resulting either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and because the action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment; and WHEREAS, the CAHOOTS program was already analyzed for environmental compliance with CEQA on May 3, 2021, when City Council approved a resolution authorizing execution of a professional service agreement with Petaluma People Services Center to implement the CAHOOTS model crisis response and intervention services program and similarly with the Downtown Streets Team program on January 27, 2020; and WHEREAS, the City Council finds and acknowledges the urgency in responding to the State HEAP funding deadline of June 30, 2021, and for the City to quickly administer the grant funds and purchase the City vehicle in accordance with the City Purchasing Ordinance, and further invest and support in our City sponsored Homeless Services Programs, which contribute to the well-being and improvement of the lives of our low and moderate income residents and the quality of life in our community, and satisfies the requirements of 24 CFR 91.200-230, as required by 24 CFR 91.200(a). NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council hereby: 1. Declares the above recitals are hereby declared to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Moreover, the CAHOOTS program was already analyzed for environmental compliance with CEQA on May 3, 2021, when City Council approved a resolution authorizing execution of a professional service agreement with Petaluma People Services Center to implement the CAHOOTS model crisis response and intervention services program and similarly with the Downtown Streets Team program on January 27, 2020 when City Council approved a resolution authorizing execution of an agreement Downtown Streets Team. 3. Approves the HEAP contract between the Sonoma County Community Development Commission and the City of Petaluma. 4. Authorizes the City Manager to execute the Sub-Recipient Agreement between the City and the Downtown Streets Team. 5. Authorizes the City Manager to execute all documents associated with the CAHOOTS van purchase, as stated in the staff report. Under the power and authority conferred upon this Council by the Charter of said City.
