Page 1 Resolution No. 2021-099 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR THE SRJC 12-INCH WATER MAIN AND MARIA – LEGHORN RECYCLED WATER MAIN EXTENSION PROJECTS, DETERMINING THAT THE MARIA-LEGHORN RECYCLED WATER MAIN EXTENSION IS WITHIN THE SCOPE OF THE PROGRAM ENVIRONMENTAL IMPACT REPORT FOR THE WATER RECYCLING EXPANSION PROGRAM, APPROVING THE PROJECT, AND ADOPTING A MITIGATION MONITORING AND REPORTING PROGRAM FOR THE PROJECT WHEREAS, the City of Petaluma General Plan 2025 recognizes the use of recycled water as a potable water offset and to meet regulatory requirements for wastewater discharge; and WHEREAS, staff desires es to increase resiliency of the City’s water distribution system; and WHEREAS, the City desires to expand its recycled water system to reduce wastewater discharges and provide additional potable water offset; and WHEREAS, on November 3, 2008, the Council, by Resolution 2008-206 N.C.S., certified the Program Environmental Impact Report (PEIR) for the Water Recycling Expansion Program (WREP); and WHEREAS, on December 7, 2015, the Council, by Resolution 2015-187 N.C.S., adopted the Resolution Certifying Addendum No. 1 to the Program Environmental Impact Report (PEIR) for the Water Recycling Expansion Program (WREP) Certified By Resolution No. 2008-206; and WHEREAS, the SRJC-12 Inch Water Main Project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Title 14, the California Code of Regulations (“CEQA” Guidelines”), Section 15302 and Section 15303, because the Project consists of replacement and reconstruction of existing systems and/or minor new construction involving negligible or no expansion of capacity and incorporates construction methods which avoid sensitive areas; and WHEREAS, determination that the Maria-Leghorn Recycled Water Main Extension Project is within the Scope of the Program Environmental Impact Report for the Water Recycling Expansion Program, approval of the Project, and adoption of Mitigation Monitoring and Reporting Program are required to satisfy the California Environmental Quality Act (CEQA) and Title 14, the California Code of Regulations (“CEQA” Guidelines”) requirements; and WHEREAS, the Maria-Leghorn Recycled Water Main Extension Project located within the WREP Recycled Water Service Area Boundary (Service Area Boundary), as shown in Figure 2 of the WREP EIR and subsequent addenda, and includes installation of recycled water pipeline segments and use of recycled water as evaluated in the program-level review in the WREP EIR and no new significant environmental effects have been identified, and no new mitigation measures are required as compared to the WREP Program EIR; and WHEREAS, none of the conditions listed in CEQA Guidelines Section 15162 (Subsequent EIRs and Negative Declarations) would occur due to the Maria-Leghorn Recycled Water Main Extension Project; and DocuSign Envelope ID: 6DCFEAC2-FD58-4899-9F45-7A7FDDCD8D92 Resolution No. 2021-099 N.C.S. Page 2 WHEREAS, City staff prepared construction bid documents and advertised for construction of the SRJC 12-Inch Water Main and Maria-Leghorn Recycled Water Main Extension Projects (C67502123; C66501834), (“the Project”); and WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and WHEREAS, the Project was bid on May 27, 2021, and eight bids were received and opened on June 10, 2021, in accordance with applicable law; and WHEREAS, the lowest responsible bid for the Project was submitted by Michael Paul Company from Petaluma, CA for $741,030; and WHEREAS, staff recommends awarding Bid Alternative 2 in the amount of $65,625.00 for total contract amount of $806,655.00; and WHEREAS, staff determined that the Contractor’s bid satisfies the bidding requirements for the Project; and WHEREAS, staff verified that Michael Paul Company possesses a valid California Contractor’s License, Class A, number 386001 that qualifies Contractor to perform the Project; and WHEREAS, the necessary funds are budgeted in the proposed 2021/2022 CIP to complete the project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Declares the above recitals to be true and correct and are incorporated herein as findings. 2. Finds that the SRJC-12 Inch Water Main Project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Title 14, the California Code of Regulations (“CEQA” Guidelines”), Section 15302 and Section 15303, because the Project consists of replacement and reconstruction of existing systems and/or minor new construction involving negligible or no expansion of capacity and incorporates construction methods which avoid sensitive areas. 3. Determines that the environmental effects of the Maria-Leghorn Recycled Water Main Extension Project were examined are within the Scope of the Program Environmental Impact Report for the Water Recycling Expansion Program and Approves the Project based on the analysis contained in Attachment 2 of the agenda report. 4. Adopts the Mitigation Monitoring and Reporting Program for the Maria-Leghorn Recycled Water Main Extension Project as included as Attachment 2 of the agenda report. 5. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162, and other applicable law, waives any and all non-conformance in the bid of Contractor for the SRJC 12-Inch Water Main and Maria-Leghorn Recycled Water Main Extension Projects (C67502123 and C66501843) and finds the bid of $741,030.00 to be the lowest, responsive bid and further finds that Michael Paul Company is the lowest responsible bidder. 6. Awards the contract for the SRJC 12-Inch Water Main and Maria-Leghorn Recycled Water Main Extension Projects (C67502123 and C66501843) to Michael Paul Company Inc. in the amount of $806,65.00, the amount of the lowest responsive bid and Bid Alternative 2, conditioned on Michael Paul Company. timely executing the project contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by Michael Paul Company of the signed project contract and all other required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 8. Approves a construction contract contingency in the amount of $895,345. Under the power and authority conferred upon this Council by the Charter of said City.
