RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN EASEMENT
AGREEMENT BETWEEN THE SONOMA COUNTY WATER AGENCY AND THE CITY OF
PETALUMA ALLOWING IMPROVEMENTS TO THE LYNCH CREEK TRAIL
WHEREAS, Caltrans MSN C2 project required an easement from Sonoma Water to replace the pedestrian
lighting and wiring underneath highway 101 overpass and Caltrans agreed to reimburse the City for cost related
to creating the necessary easement and taking it to Sonoma Water Board for approval; and
WHEREAS, City applied and was awarded funds through Transportation Funds for Clean Air to construct a
10-foot-wide class I facility from pedestrian foot bridge over East Washington Creek to Payran Street and awarded
the construction contract to Team Ghilotti to construct the new class I facility; and
WHEREAS, City developed public bicycle and pedestrian path and electrical conduit easement along Lynch
Creek Trail over Sonoma Water property; and
WHEREAS, the Project was previously analyzed under the California Environmental Quality Act (“CEQA”)
with the Petaluma General Plan Environmental Impact Report, filed with the Office of Planning and Research
State Clearinghouse Number 2004082065 and the project is exempt pursuant to California Environmental Quality
Act (“CEQA”) pursuant to Title 14, the California Code of Regulations (“CEQA Guidelines”), Section 15301, as
the minor alteration of existing public facilities with negligible or no expansion in use and there are no cumulative
impacts, unusual circumstances, or other factors that would make the exemption inapplicable pursuant to CEQA
Guidelines section 15300.2.
NOW THEREFORE, BE IT RESOLVED, that the Petaluma City Council hereby:
1. Declares the above recitals are hereby declared to be true and correct and are incorporated into this resolution
as findings of the City Council.
2. Finds the Project was previously analyzed under the California Environmental Quality Act (“CEQA”) with
the Petaluma General Plan Environmental Impact Report, filed with the Office of Planning and Research State
Clearinghouse Number 2004082065 and the project is exempt pursuant to California Environmental Quality
Act (“CEQA”) pursuant to Title 14, the California Code of Regulations (“CEQA Guidelines”), Section 15301,
as the minor alteration of existing public facilities with negligible or no expansion in use and there are no
cumulative impacts, unusual circumstances, or other factors that would make the exemption inapplicable
pursuant to CEQA Guidelines section 15300.2.
3. Authorizes the City Manager to execute the easement agreement between the City of Petaluma and Sonoma
Water.
Under the power and authority conferred upon this Council by the Charter of said City.

Council of the City of Petaluma at a Regular meeting on the 21st day of June
