SUBJECT: Resolution Accepting Completion of the 1 Oth Street Water and Sewer Main
Replacement Project
RECOMMENDATION
It is recommended that the City Council adopt the attached Resolution accepting completion of
the 10th Street Water and Sewer Main Replacement Project.
BACKGROUND
The project included replacement of the undersized 1 `h -inch water.main with a new 6 -inch
water main, new water services and fire hydrant, and removal and replacement of the old and
deteriorated 6 -inch vitrified clay pipe (VCP) sewer main with a new 6 -inch sewer main. The
project also rehabilitated the existing street. These improvements will improve service, reduce
maintenance costs and significantly reduce inflow and infiltration.
Bids were opened.in December 2010. On January 3, 2011, the City Council awarded. the.
construction contract to Argonaut Constructors of Santa Rosa, CA, in the amount of $138,335.
Construction was successfully completed on May 27, 2011.
(DISCUSSION
Following the acceptance of the project, the City Clerk will file a Notice of Completion with the
Sonoma ,County Recorder- and the Finance Division will release the retention money to the
contractor' within 60 days. Retention for the project totals $17,148.30.
FINANCIAL IMPACTS
The 10th Street Water and ; Sewer Main Replacement, City Project Number C66401.003, was
approved in the Wastewater CIP with a budget of $367,000. The final construction contract cost
is $171,483, including change totaling,, $24,935 and changes to ,unit price quantities
totaling $8,213. Extra work included street section modifications due to adverse subgrade
conditions, removal,and replacement of manholes, extra-work at the water main tie -in, lateral

installation and sidewalk due4o unanticipated site conditions Project costs also included
constructon,management performed by Public Works staff at cost.of approximately $7,500,
and a Professional Services Agreement for geotechni'cal and,'materials testing with Miller:Pacific,
Inc. at a cost
of $10,800. Project. design was done in -house by Water Resources and
Conservation staff; design costs ure•captured in the CIP administration budget. Total project cost
to date is approximately $189,783. The current account balance is approximately $177, 217. At
project closeout, all remaining funds will return to'the Wastewater CIP to be used on future
projects.
This project involved water, wastewater and street improvements. Based on actual construction
costs, a budget adjustment will be made to transfer $71,622 from the Water Fund to the
Wastewater Fund to! pay for all costs associated with the water main replacement and $8,300
from the Street Maintenance Fund to the Wastewater Fund to pay Public Works fair share cost of
road improvements above what would be required for utility installation.

RESOLUTION ACCEPTING COMPLETION OF THE
IOTH ST'RE'ET WATER AN D 'SEWER MAIN REPLACEMENT PROJECT
WHEREAS, in accordance with Section, 68 of Article.X of the City of Petaluma Charter,
Section 20.162 of the California Public Contract Code and other applicable laws, the City of
Petaluma solicited bids for the 10th Street `Water and Sewer Main'Project ( "Project "); and
WHEREAS,; bids for'the Project were opened on December 21, 2010 in accordance with
California Public Contract Code Section'4104.5 and other= applicable laws; and
WHEREAS,, the apparent.,low bid 'for the Project was the bid of Argonaut Constructors
(Argonaut) in the amount of $138;335; and
WHEREAS, by Resolution No. 2011-002 N.C.S. adopted, January 3, 2011, the City
Council of the City of Petaluma found the bid of $.138,335° for the 'Project. to be the lowest
responsive bid and awarded the Project to Argonaut in the amount of $138,33'5 conditioned on
Argonaut's timely executing the Project contract and submitting all required documents and
authorized and directed the City Manager to sign the Project contract on behalf of the City upon
such timely submission and to execute on behalf of the City any, amendments to the Project
contract that are necessary to effectively complete the project and/or to realize the Project and/or
cost benefits for the City; and
WHEREAS, the following change'orders (CO) affecting the Project amount have been
approved:
CO No. 1: Extra work at water main tie -in, lateral location and concrete $ 8
CO No. 2: Street section. modifications due to adverse subgradeconditions $16,032
Total Change'Orders: $24,935; and
WHEREAS, the fmal''contract amount as amended, including all change orders is
$171,483; and
WHEREAS,, City staff has inspected the Project and determined that it has been
completed: in: accordance with the contract requirements subject to the Contractor's continuing
warranty and tother obligations pursuant to the contract ;: and
WHEREAS, based, on the foregoing, staff recommends acceptance of the Project on
behalf of the City;

NOW, THEREFORE, BE` IT RESOLVED b_y'the City Council of the City of Petaluma
as follows`
1. The "con
tract entitled. 10th . Street Water and Sewer Main Replacement; City Project,
Number C66401003 with a final contract; amount of $,1 is accepted as
complete subject to the Contractor's continuing warranty other obligations
pursuant to the'contract.
2. The, City Clerk/Recording; S is hereby authorized and .directed to file a Notice
of Completion concerning the: Project with the Sonoma County Clerk's Office within
ten (10) days oft he date of this Resolution.
3. Staff is hereby' authorized and directed to release all undisputed retention not subject
to pending change order"& within sixty (60) days of the date ofthis Resolution and in
accordance with the. terms of the Project contract, California Public Contract Code
Section 7107 and �applicable'law.
