HomeMy WebLinkAboutResolution 95-265 10/16/1995 ~e~'S®lu~~®~ 95-265 N.C.~. of the City of Petaluma, California 1 2 RESOLiJTION OP THE CITx COUNCIL OF PETALi1MA 3 AFFIRMINCp THAT HIV TESTING OF INMATES AND ARRESTEES 4 IS OPERATIVE IN CORRECTIONAL INSTITiJTIONS UNDER THE 5 JURISDICTION OF THE PETALIIMA POLICE DEPARTMENT. 6 7 8 WHEREAS, the public peace, health, and safety is endangered by the spread of 9 acquired immune deficiency syndrome (AIDS); and 10 11 WI-IEREAS, the spread of AIDS presents a grave danger to law enforcement 12 personnel who come into contact with arrestees .and prisoners infected with the AIDS 13 virus; and 14 15 WHEREAS, law enforcement personnel are particularly vulnerable to this 16 danger, due to assaults and other violent acts to which they are exposed in the course 17 and scope of their duties; and 18 19 WHEREAS, the protection of the health and safety of these personnel is of 2 o great importance to the citizens of Petaluma, and 21 2 2 WHEREAS , the testing of individuals described in Penal Code Section 7510 23 (i.e. inmates, persons taken into custody whether or not charged with an offense, wards 2 4 of the court under Section 602 of the Welfare and Institutions Code, or persons on 25 parole or probation, etc.) for evidence of infection by the HIV virus would help 2 6 provide a level of information necessary for effective disease control, and would help 2 ~ preserve the health of law enforcement personnel, inmates and the public at large; and 28 29 WHEREAS, such testing would be undertaken only in those cases deemed 3 o appropriate by the Chief Medical Officer of Sonoma. County and in compliance with all 31 legal requirements, including those provisions pertaining to the confidentiality of 3 2 testing results. - Res. No...........9.~.-.~.V.~.. N.C.S. 33 3 4" N:®BV, TI~EREFORE, BE IT RESOLVED that° the City Council of Petaluma 3 5 authorizes the provisions of Title 8 of Part 3 of the Penal Code (sections 7500 et seq.) 3 6 regarding. the medical testing of persons .thereindesignated for the HIV virus to be 3 7 operative in all areas within the jurisdiction of the Petaluma Police Department to the 38 extent provided by law. 39 40 41 42 43 44 45 46 47 4g 4.9 ' 50 51 52 5.3 54 55 56 57 Under the power and authority conferred upon this Council by the Charter of said City.
