Page 1 Resolution No. 2020-187 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR THE TENNIS & PICKLEBALL COURT RENOVATION: RESURFACING FOR COURTS AT LUCCHESI AND MCNEAR PARK PROJECT TO VINTAGE CONTRACTORS, INC. WHEREAS, staff wishes to make improvements to the Lucchesi and McNear Park Tennis Courts to help increase safety for all members of the public; and WHEREAS, City staff has prepared construction bid documents and advertised for construction for the Tennis & Pickleball Court Renovation: Resurfacing for Courts at Lucchesi and McNear Park Project C14502011 (“Project”); and WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and WHEREAS, the Project was bid on November 19, 2020, and one bid was received and opened on December 3, 2020 in accordance with applicable law; and WHEREAS, the lowest responsible base bid for the Project at Lucchesi Park was submitted by Vintage Contractors, Inc., San Francisco, CA for $168,250.00; and WHEREAS, the tennis courts at McNear and Del Oro Park will be reconstructed at a cost of $70,650 and $106,100, respectively, for a total reconstruction cost of $345,000. WHEREAS, the bid submitted by Vintage Contractors, Inc was found by staff to be fair and reasonable; and satisfies the bidding requirements for the Project; and WHEREAS, staff has verified that Vintage Contractors, Inc possesses a valid California Contractor’s License, Class A (General Engineering Contractor), number 416130 that qualifies Contractor to perform the Project; and WHEREAS, the Project is categorically exempt pursuant to California Environmental Quality Act (CEQA) and Title 14, the California Code of Regulations (“CEQA” Guidelines”), Section 15302, because the Project consists of replacement and reconstruction of existing systems and/or facilities involving negligible or no expansion of capacity; and WHEREAS, the FY 20/21 CIP budget will require a mid-year budget adjustment in the amount of $355,000 carrying forward unspent appropriations from the prior year; and WHEREAS, the City has an Interfund Loan Policy that allows the internal transfer of funding and agreement that the City will repay the loan through savings generated by less maintenance costs on existing courts. NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Petaluma hereby: 1. Approves the project budget for the Tennis & Pickleball Court Renovation: Resurfacing for Courts at Lucchesi and McNear Park Project. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, waives any and all non-conformance in the bid of Vintage Contractors, Inc for the Tennis & Pickleball Court Renovation: Resurfacing for Courts at Lucchesi and McNear Park Project, Project No. C14502011 finds that Vintage Contractors, Inc. is the lowest responsible bidder with a bid of $168,250.00. 3. Awards the contract for the Tennis & Pickleball Court Renovation: Resurfacing for Courts at Lucchesi and McNear Park Project, Project No. C14502011 to Vintage Contractors, Inc, in the amount of $168,250.00, the amount of the lowest responsive bid, conditioned on Vintage Contractors, Inc’s timely executing the project contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 4. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by Vintage Contractors, Inc, of the signed project contract and all other required document, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 5. Approves bid alternate #1 for $70,650. 6. Approves a construction contract contingency of $106,100. 7. Finds based upon the staff report and information provided that this project is in the best interest of the city, and that funds for the repayment of the loan are projected to be available from Measure M revenue available from funding that would of otherwise have been used for continued and ongoing maintenance. 8. The amount of the loan and repayment to be covered by the Agreement shall be set pursuant to provisions in the Interfund Loan Policy but shall not exceed $396,000 (three hundred ninety-six thousand dollars) and the maximum term of the loan of 10 years. 9. Authorize the City Manager to take all actions to effectuate this loan. 10. Approves the Tennis and Pickleball Court Reconstruction budget in the amount of $440,000; of which $396,000 funded through an interfund loan. Under the power and authority conferred upon this Council by the Charter of said City.
