Page 1 Resolution No. 2021-131 N.C.S. of the City of Petaluma, California RESOLUTION DELEGATING AUTHORITY TO AWARD A CONSTRUCTION AGREEMENTS TO AN ELECTRICAL CONTRACTOR FOR THE BUILDING MODIFICATIONS TO THE PETALUMA COMMUNITY CENTER FOR A TEMPORARY GENERATOR TO THE CITY MANAGER WHEREAS, in efforts to reduce wildfire risk and to prevent ignition of new fires PG&E and other energy utilities shut down electric lines during extreme fire-weather events; and WHEREAS, the Petaluma Community Center has been used as an emergency shelter during power outages and evacuations caused by fires; and WHEREAS, it is necessary to rent a temporary generator and to modify the Petaluma Community Center to house the temporary generator to provide services to community members and/or evacuees in the event of a power outage or other emergency; and WHEREAS, due to the extreme drought conditions in California vegetation is historically dry, exacerbating the current fire season; and WHEREAS, Cal Fire states that “the fire season in California… is starting earlier and earlier each year;” and WHEREAS, California has already seen more than three times as much land burned this year than during the same time span as last year; and WHEREAS, City staff has prepared construction bid documents and advertised for construction for the Community Center Emergency Generator Purchase and Building Modifications Project C11202116 (“Project”); and WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, specifically the formal bidding procedures of Section 4.04.080 of the Petaluma Municipal Code, staff is in the process of soliciting bids for the Project; and WHEREAS, the Project shall be bid on August 5, 2021, bids shall be received and opened in accordance with applicable law; and WHEREAS, the next Petaluma City Council meeting is scheduled for September 13, 2021, which means that if City Council were to award the bid on this date instead of staff as proposed in this Resolution, the Project would be estimated to finish on October 5, 2021; and WHEREAS, if staff were to award the bid to the lowest responsible bid as proposed in this Resolution, the estimated finish date on this Project is September 15, 2021; and WHEREAS, due to the 20-day difference between the estimated Project completion dates if City Council were to award the Project at the September 13, 2021, City Council meeting and as proposed in this Resolution and the extreme dangers of this fire season it is in the City’s best interest to complete the Project as soon as possible; and DocuSign Envelope ID: D1FAE4BA-3E6F-40D1-BD0F-5270151BCE0A Resolution No. 2021-131 N.C.S. Page 2 WHEREAS, the Project is categorically exempt pursuant to California Environmental Quality Act (CEQA) and Title 14, the California Code of Regulations (“CEQA” Guidelines”), Section 15301, because the Project consists of minor alteration of existing public structure involving negligible or no expansion of capacity. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Declares that the above recitals are true and correct and are incorporated into this resolution as findings of the City Council. 2. Finds that the Project is categorically exempt pursuant to California Environmental Quality Act (CEQA) and Title 14, the California Code of Regulations (“CEQA” Guidelines”), Section 15301, because the Project consists of minor alteration of existing public structure involving negligible or no expansion of capacity. 3. Directs staff to review the apparent low bidder’s submittal for completeness, accuracy and determine that the low bid contractor’s bid satisfies the bidding requirements for the Project. 4. Directs the City Clerk to document and rank all bids and that the lowest responsible bid shall be announced on the Public Works and Utilities Bid webpage. 5. Directs staff to verify that the low bid contractor holds a valid California Contractor’s License that qualifies Contractor to perform the Project. 6. Authorizes staff, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, to waive any and all non-conformance in the low bid contractor’s bid to be the lowest, responsive bid as they see fit, and to further find the lowest responsible bidder. 7. Authorizes staff to award the contract for the Community Center Emergency Generator Purchase and Building Modifications Project, Project No. C11202116 to the lowest bidder, in the amount of the lowest responsive bid, conditioned on the low bid contractor timely executing the project contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 8. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by the low bid contractor, of the signed project contract and all other required document, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 9. Approves a construction contract contingency of $10,000. Under the power and authority conferred upon this Council by the Charter of said City.
