Resolution No. 2021-025 N.C.S.
of the City of Petaluma, California
RESOLUTION ACCEPTING COMPLETION OF THE
TRANSIT CENTER PARKING & ADA IMPROVEMENTS PROJECT BY
COASTSIDE CONCRETE & CONSTRUCTION, INC.
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and
WHEREAS, the Project was bid on February 20, 2020, and nine bids were received and opened on March 11,
2020 in accordance with applicable law; and
WHEREAS, the lowest responsible bid for the Project was submitted by Coastside Concrete and
Construction, Inc. from Santa Rosa, CA for $120,547.00; and
WHEREAS, by Resolution No 2020-044 N.C.S. adopted April 20, 2020, the City Council found the bid of
$120,547 for the project to be the lowest responsive bid, awarded the project to Coastside Concrete and
Construction Inc., conditioned on Coastside Concrete and Construction Inc.’s timely executing the project
contract and submitting all required documents and authorized and directed the City Manager to sign the project
agreement on behalf of the City; and
WHEREAS, the Project consists of a minor activity to install an ADA compliant ramp at an existing public
building; all improvements occurred in an area that was previously disturbed and was surrounded by existing
development, including landscaping, buildings, and parking; the project will provide accessibility to the existing
Transit Center; there is negligible or no expansion of use beyond what currently exists and there no cumulative
impacts, unusual circumstances or other factors that would make the exemption inapplicable; and therefore, when
the Project was awarded pursuant to Resolution No 2020-044 N.C.S. adopted April 20, 2020, the City Council
found the project to be exempt under Section 15302, existing facilities, and Section 15062(b)(3), Common Sense,
in that it could be seen with certainty that the project would not result in a significant environmental impact; and
WHEREAS, the following contract change orders (CCO) for various unforeseen items including adjusted
final quantities of sidewalk, curb and gutter and handrail installation along with additional street paving to account
for site grade changes during construction for the amount below have been approved:

Change Order #1 $ 15,000
Change Order #2 $ 2,790
Total Change Orders $ 17,790;
and
WHEREAS, the final contract amount, as amended, including all change orders, overruns, and underruns, is
$138,337.00 and is within the approved project budget; and
WHEREAS, the FY 19/20 CIP budget was sufficient to complete the project as bid.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows:

1. The above recitals are hereby declared to be true and correct and are incorporated into this resolution as
findings of the City Council.
2. The Project consists of a minor activity to install an ADA compliant ramp at an existing public building. All
improvements occurred in an area that was previously disturbed and was surrounded by existing development,
including landscaping, buildings, and parking. The project will provide accessibility to the existing Transit
Center. There is negligible or no expansion of use beyond what currently exists and there no cumulative
impacts, unusual circumstances or other factors that would make the exemption inapplicable. When the project
was awarded pursuant to Resolution No 2020-044 N.C.S. adopted April 20, 2020, the City Council found the

3. The contract titled Transit Center Parking & ADA Improvements Project, project no. C65102009, with the
final contract amount of $138,337 is accepted as complete, subject to the Contractors continuing warranty and
other obligations pursuant to the contract.
4. The City Clerk is hereby authorized and directed to file a Notice of Completion concerning the project with
the Sonoma County Clerk’s office within ten (10) days of the date of this Resolution.
5. Staff are hereby authorized and directed to release all undisputed retention not subject to pending change
orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the project
contract, California Public Contract Code Section 7107, and applicable law.
Under the power and authority conferred upon this Council by the Charter of said City.
REFERENCE: I hereby certify the foregoing Resolution was introduced and adopted by the
Council of the City of Petaluma at a Regular meeting on the 1st day of March
