Page 1 Resolution No. 2021-114 N.C.S. of the City of Petaluma, California RESOLUTION APPROVING THE PURCHASE OF A VAC-CON HYDRO-EXCAVATOR FROM MUNICIPAL MAINTENANCE EQUIPMENT FOR THE PUBLIC WORKS & UTILITIES’ WATER DEPARTMENT TOTALING $473,839.96 THROUGH SOURCEWELL COOPERATIVE PURCHASING PROGRAM AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS NECESSARY TO COMPLETE THE PURCHASE WHEREAS, the City of Petaluma seeks to purchase the replacement of one Vac-Con Hydro Excavation truck; and WHEREAS, Section 4.04.050 of the Petaluma Municipal Code allows formal bidding procedures to be dispensed with when the commodity can be obtained from only from one vendor; and WHEREAS, the City is a member of the Sourcewell Cooperative Purchasing Program (formerly National Joint Powers Alliance) which supports cooperative purchasing, allowing the City the opportunity to access competitively awarded and nationally leveraged cooperative purchasing contracts; and WHEREAS, the Sourcewell Cooperative Purchasing Program provides an advantage by creating an opportunity to access competitively awarded nationally leveraged cooperative purchasing contracts in accordance with Petaluma Municipal Code Section 4.01.100; and WHEREAS, the lowest Sourcewell cooperative price meeting specifications for the hydro-excavator truck was a Vac-Con Hydro Excavator truck submitted by Mutual Maintenance Equipment (MME) for $473,839.96; and WHEREAS, a Vac-Con hydro-excavator truck is consistent with other (City-owned) equipment using the same repair parts, training, operation and is operationally better to fit our smaller streets on the West side; and WHEREAS, the City will receive $13,000 in trading in its current Vac-Con truck from MME with the purchase of the new Vac-Con truck; and WHEREAS, funds in the amount of $400,000 were included and approved in the FY 20/21 budget for the purchase of the equipment, together with 21/22 repairs and maintenance operating funds, coupled with $25,000 savings from purchase of the flushing truck with a concurrent resolution, and current operating funds available and has a total of $480,000 available; and WHEREAS, the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, in that replacing a Vac-Con hydro-excavator truck does not meet CEQA's definition of a “project,” because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and because the action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment; and WHEREAS, if the proposed action did constitute a project under CEQA the action is exempt under the common-sense exemption, CEQA Guidelines Section 15061(b)(3) and any work performed with the equipment would be exempt pursuant to CEQA Guidelines Section 1530, Existing Facilities, as the truck would be used for the operation, repair, or maintenance of existing streets and sewers. Declares the above recitals to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Finds that the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, in that replacing a Vac-Con hydro-excavator truck does not meet CEQA's definition of a “project,” because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and because the action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. And if the proposed action did constitute a project under CEQA the action is exempt under the common-sense exemption, CEQA Guidelines Section 15061(b)(3) and any work performed with the equipment would be exempt pursuant to CEQA Guidelines Section 1530, Existing Facilities, as the truck would be used for the operation, repair, or maintenance of existing streets and sewers. 3. Finds that purchasing the Vac-Con Hydro Excavator truck through the Sourcewell Cooperative Purchasing Program is in compliance with the purchasing requirements of the Petaluma Charter and Municipal Code. 4. Approves the purchase of one Vac-Con Hydro Excavator truck for $473,839.96 (tax included). 5. Authorizes the City Manager to execute all necessary documents to complete the purchase. Under the power and authority conferred upon this Council by the Charter of said City.
