Page 1 Resolution No. 2021-120 N.C.S. of the City of Petaluma, California RESOLUTION ACCEPTING COMPLETION OF THE WATER SERVICE REPLACEMENT PROJECT 19/20 BY TEAM GHILOTTI, INC. WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff prepared construction bid documents and solicited bids for the Water Services Replacement 19/20 Project C67502019 (Project); and WHEREAS, the project was bid on June 11, 2020 and six (6) bids were received and opened on July 1, 2020 in accordance with applicable law; and WHEREAS, the lowest responsible bid for the Project was submitted by Team Ghilotti, Inc. from Petaluma, CA for $1,107,141; and WHEREAS, by Resolution No 2020-128 N.C.S. adopted August 3, 2020, the City council found the bid of $1,107,141 for the project to be the lowest responsive bid, awarded the project to Team Ghilotti, Inc., conditioned on Team Ghilotti’s timely executing the project contract and submitting all required documents and authorized and directed the City Manager to sign the project agreement on behalf of the City; and WHEREAS, the following contract change orders (CCO) for additional replacement of water services, emergency repair work, installation of recycled water filling stations, and misc. construction items affecting the project amount have been approved: Cost Change Order #1 $ 15,332.93 Change Order #2 Change Order #3 $ 9,184.81 $ 171,629.00 Change Order #4 $ 5,149.90 Change Order #5 $ 74,318.00 Change Order #6 $ 24,481.81 Change Order #7 $ 65,918.00 Decrease in quantities -$ 113,333.00 Total Change Orders and decrease in quantities $ 222,681.45; and WHEREAS, the final contract amount, as amended, including all change orders, overruns, and underruns, is $1,359,822.45 and is within the approved project budget; and WHEREAS, based on the foregoing, staff recommends acceptance of the project on behalf of the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: 1. The contract titled Water Service Replacement 19/20 Project, project no. C67502019, with the final contract amount of $1,359,822.45 is accepted as complete, subject to the Contractor’s continuing warranty and other obligations pursuant to the contract. 2. The City Clerk is hereby authorized and directed to file a Notice of Completion concerning the project with the Sonoma County Clerk’s office within ten (10) days of the date of this Resolution. Staff are hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the project contract, California Public Contract Code Section 7107, and applicable law. Under the power and authority conferred upon this Council by the Charter of said City.
