Page 1 Resolution No. 2021-121 N.C.S. of the City of Petaluma, California RESOLUTION ACCEPTING COMPLETION OF THE TENNIS & PICKLEBALL COURT LED LIGHTING UPGRADE FOR COURTS AT LUCCHESI AND MCNEAR PARK PROJECT BY DC ELECTRIC GROUP, INC. WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and WHEREAS, the Project was bid on November 19, 2020, and Three (3) bids were received and opened on December 3, 2020 in accordance with applicable law; and WHEREAS, the lowest responsible bid for the Project was submitted by DC Electric Group, Inc. from Cotati, CA for $38,602.00; and WHEREAS, by Resolution No 2020-187 N.C.S. adopted December 21, 2020, the City council found the bid of $38,602.00 for the project to be the lowest responsive bid, awarded the project to DC Electric Group, Inc., conditioned on DC Electric Group, Inc.’s timely executing the project contract and submitting all required documents and authorized and directed the City Manager to sign the project agreement on behalf of the City; and WHEREAS, the following contract change order for various unforeseen items including light pole re-wiring and timer clock installation to support the new LED lighting system during construction for the amount below have been approved: Cost Change Order #1 $ 1,192.00 Total Change Orders $ 1,192.00; and WHEREAS, the final contract amount, as amended, including all change orders, overruns, and underruns, is $39,794.00 and is within the approved project budget; and WHEREAS, the FY 20/21 CIP budget is sufficient to complete the project as bid. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. The contract titled Tennis & Pickleball Court LED Lighting Upgrade for Courts at Lucchesi and McNear Park Project, Project No. C16501412, with the final contract amount of $39,794.00 is accepted as complete, subject to the Contractors continuing warranty and other obligations pursuant to the contract. 2. The City Clerk is hereby authorized and directed to file a Notice of Completion concerning the project with the Sonoma County Clerk’s office within ten (10) days of the date of this Resolution. 3. Staff are hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the project contract, California Public Contract Code Section 7107, and applicable law.
