Introduced by: D’Lynda Fischer Seconded by: Dennis Pocekay AN ORDINANCE OF THE COUNCIL OF THE CITY OF PETALUMA AMENDING ORDINANCE NO. 2732 N.C.S. TO CHANGE UTILITIES FUNDS APPROPRIATIONS FOR THE OPERATION OF THE CITY OF PETALUMA FROM JULY 1, 2020 TO JUNE 30, 2021 WHEREAS, on July 1, 2020, City Council adopted the FY 2020-21 Budget Appropriations ordinances; and WHEREAS, in accordance with City Charter Section 60, City Council may amend an annual appropriation ordinance; and WHEREAS, a duly noticed public hearing was held on March 8, 2021 to consider information presented by staff and receive public comment regarding amending ordinance No. 2732 N.C.S. to change utilities funds appropriations for the operation of the City of Petaluma from July 1, 2020 to June 30, 2021; and WHEREAS, on March 8, 2021, after considering information presented by staff and hearing public comments, City Council approved the first introduction of the Ordinance amending Ordinance No. 2732 N.C.S. by a vote of 7-0; and WHEREAS, the recommended ordinance amendment will further City Council goals and improve the City of Petaluma; and WHEREAS, this action is exempt from the California Environmental Quality Act (CEQA) because it is not a project which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, pursuant to CEQA Guideline section 15378, because this action merely amends the City’s annual appropriations ordinance in accordance with Section 60 of the City Charter. NOW THEREFORE BE IT ORDAINED by the City Council of the City of Petaluma as follows: Section 1. The above recitals are hereby declared to be true and correct and are incorporated into the Ordinance as findings of the City Council. Section 2. This action is exempt from the California Environmental Quality Act (CEQA) because it is not a project which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, pursuant to CEQA Guideline section 15378, because this action merely amends the City’s annual appropriations ordinance in accordance with Section 60 of the City Charter. Ordinance No. 2732 N.C.S. is hereby amended for the fiscal year beginning on July 1, 2020 and ending on June 30, 2021 in the amounts as set forth in the attached Exhibit A, incorporated herein by reference, and distributed to the various funds as set out in said exhibit and shall be expended and used in accordance therewith. Section 4. The City Council hereby finds and determines that the amount of appropriations provided hereby does not exceed the estimated revenue, other sources and available fund balances for the fiscal year ending June 30, 2021. Section 5. All ordinance or parts of ordinances in conflict herewith are hereby repealed. Section 6. Severability. If any section, subsection, sentence, clause, phrase or word of this ordinance is for any reason held to be unconstitutional, unlawful or otherwise invalid by a court of competent jurisdiction or preempted by state legislation, such decision or legislation shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional, unlawful or otherwise invalid. Section 7. The City Clerk is hereby directed to post/publish this ordinance or a synopsis of this ordinance for the period and in the manner required by the City Charter and State Law.
