HomeMy WebLinkAboutResolution 94-36 02/22/1994ReSO1Ut101'1 No. 94-36 N C.S. of the City of Petaluma, California RESOLUTION MODIFYING PROPOSED PUBLIC SAFETY ASSESSMENT AND SUBMITTING PROPOSAL TO ELECTION The City Council of the City of Petaluma resolves: WHEREAS, on December 20, 1993, the City Council adopted Resolution of Intention # 93-326 N.C.S. to levy a special assessment representing a portion of the cost of City police and fire services in the protection and preservation of real property, and directed the filing of an Assessment Report, all as provided in Ordinance 1946 N.C.S., an Ordinance Amending the Municipal Code by Adding Chapter 4.30 Establishing Procedures for the Levy of Special Assessment for Police and Fire Services Related to Real Property (the "Ordinance") of the Petaluma Municipal Code; and WHEREAS, on December 20, 1993, the City Council adopted Resolution # 93-328 N.C.S. which accepted the Preliminary Assessment Report and called for two public hearings on the proposal and the Report. Notice of the hearings was sent by postcard to all owners of real property within the City, as evidenced by the affidavit of the City Clerk; and WHEREAS, the hearings were duly held on January 18, 1994 and on February 7, 1994, and the testimony of all interested persons was received by this Council. Supplementary reports and data were received from BSI Consultants, Inc., Assessment Consultant. NOW THEREFORE BE IT RESOLVED that the City Council finds that: (1) All proceedings heretofore taken concerning the proposed public safety assessment have been in accordance with the Constitution and laws of the State of California and with the Ordinance; (2) Written protests to the proposed public safety assessment have been timely filed by property owners representing 16.95 % of revenue to be derived from the levy of the proposed assessment; and (3) More than twelve (12) registered voters reside within the territory proposed to be assessed. BE IT FURTHER RESOLVED that the City Council hereby modifies the Resolution of Intention and the Assessment Report by reducing, from twenty (20) years to ten (10) years, the period during which the proposed public safety assessment is to be collected. In other respects the Assessment Report as supplemented will stand as the official report for all further proceedings. Res. No....94-36.._..., ... N.cs. ~E IT FURTHER ~tESOLVED that pursuant to the Ordinance, the City Council hereby determines that the proposed public safety assessment shall be submitted to a vote of the registered voters within the territory proposed to be assessed, at an election to be held not less than ninety (90) days nor more than one hundred eighty (180) days from the date of this resolution. Under the power and authority conferred upon this Council by the Charter of said City.
