Resolution No. 2021-143 N.C.S.
Of the City of Petaluma, California
RESOLUTION AUTHORIZING ACCEPTANCE OF CONTRACT FOR THE
LIBRARY ROOF OVERLAY PROJECT
WHEREAS, City staff has prepared construction bid documents and advertised for construction for the
Library Roof Overlay Project C11201603 (“Project”); and
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and
WHEREAS, bid for the Project were opened on June 16, 2020, in accordance with applicable law; and
WHEREAS, the apparent low bid for the Project was the bid of Henris Roofing Company Inc. in the amount
of $69,614.00; and
WHEREAS, by Resolution No. 2020-108 adopted July 6, 2020, the City Council of the City of Petaluma
found the bid of $69,614.00 for the Project to be the lowest responsive bid and awarded the Project to Henris
Roofing Company Inc. in that amount; and
WHEREAS, no contract change orders were executed affecting the project amount, the final construction
contract amount as amended including the deletion of an unused allowance for minor roof repairs is $67,614.00;
and
WHEREAS, City staff have inspected the Project and determined that it has been completed in substantial
accordance with the contract requirements subject to the Contractor’s continuing warranty and other obligations
pursuant to the contract; and
WHEREAS, based on the foregoing, it is recommended that Council accepts the Project on behalf of the
City; and
WHEREAS, unused funds will be returned to the Transient Occupancy Tax fund upon project closeout.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows:
1. The above recitals to be true and correct and are incorporated into this resolution as findings of the City
Council.
2. Environmental compliance was already analyzed with the July 6, 2020 Council resolu tion awarding the
Library Roof Overlay Project, which was determined to be categorically exempt pursuant to California
Environmental Quality Act (CEQA) and Title 14, the California Code of Regulations (“CEQA”
Guidelines”), Section 15302, because the Project consists of reconstruction of existing systems and/or
minor new construction involving negligible or no expansion of capacity.

3. The contract entitled Petaluma Library Roof Overlay Project No. C11201603 with a final construction
contract amount of $67,614 is accepted as complete subject to the Contractor’s continuing warranty and
other obligations pursuant to the contract.
4. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion
concerning the Project with the Sonoma County Clerk’s Office within ten (10) days of the date of this
Resolution.
5. Staff is hereby authorized and directed to release all undisputed retention not subject to pending change
orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the Project
contract, the Petaluma City Charter, California Public Contract Code Section 7107, and applicable law.
6. Authorize $8,000 in unused funds from the Petaluma Library Roof Overlay Project No. C11201603
budget to be returned to the Transient Occupancy Tax, in conjunction with the next Budget Adjustment.
Under the power and authority conferred upon this Council by the Charter of said City.
REFERENCE: I hereby certify the foregoing Resolution was introduced and adopted by the
Council of the City of Petaluma at a Regular meeting on the 13th day of
