Page 1 Resolution No. 2021-160 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING THE APPLICATION AND ADOPTING THE PLANNED LOCAL HOUSING ALLOCATION PLAN FOR THE PERMANENT LOCAL HOUSING ALLOCATION PROGRAM AND AUTHORIZING THE CITY MANGER TO EXECUTE ANY CONTRACTS FOR PROGRAM WHEREAS, the Department of Housing and Community Development (“Department”) is authorized to provide up to $304 million under the SB2 Permanent Local Housing Allocation Program Formula Component from the Building Homes and Jobs Trust Fund for assistance to Cities and Counties as described in Health and Safety Code section 50470 et seq.; and WHEREAS, the State of California (the “State”), Department issued a Notice of Funding Availability (“NOFA”) dated 5/3/2021 under the Permanent Local Housing Allocation (PLHA)Program; and WHEREAS, the City of Petaluma is an eligible Local government who has applied for program funds to administer one or more eligible activities, or a Local or Regional Housing Trust Fund to whom an eligible Local government delegated its PLHA formula allocation; and WHEREAS, the Department may approve funding allocations for PLHA Program, subject to the terms and conditions of the Guidelines, NOFA, Program requirements, the Standard Agreement, and other contracts between the Department and PLHA grant recipients; and WHEREAS, in accordance with Section 302(c) of the Department’s Local Guide, the City’s PLHA Plan (“Plan”), attached hereto as Exhibit A, details the manner in which funds will be used for eligible activities, describes how the Plan is consistent with the programs set forth in the City’s Housing Element, and describes how the City will prioritize investments that increase the supply of affordable housing; and WHEREAS, this item was agenized in compliance with state and local laws; and WHEREAS, the proposed action is exempt from the requirements of the California Environmental Quality Act (“CEQA”) in accordance with CEQA Guidelines Section 15378, as the action does not meet CEQA's definition of a “project,” because applying for a grant is not a project as it does not commit the City to a definite course of action (See City of Irvine v. County of Orange (2013) 221 Cal 4th 846, 865) and because this action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment; further any use of the grant funds if received will have its own analysis for compliance with CEQA. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Declares the above recitals to be true and correct and are incorporated herein by reference. 2. Finds that the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, as the action does not meet CEQA's definition of a “project,” because applying for a grant is not a project as it does not commit the City to a definite course of action (See City of Irvine v. County of Orange (2013) 221 Cal 4th 846, 865) and because this action constitutes organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment; further any use of the grant funds if received will have its own analysis for compliance with CEQA. Authorizes the City Manager or other authorized representative to execute the PLHA Program Application, the PLHA Standard Agreement and any subsequent amendments or modifications thereto, as well as any other documents which are related to the Program or the PLHA grant awarded to Applicant, as the Department may deem appropriate. The amount shall not to exceed the five-year estimate of the PLHA formula allocations, as stated in Appendix C of the current NOFA of $1,106,142,000 in accordance with all applicable rules and laws. 4. If City receives a grant of PLHA funds from the Department pursuant to the above referenced PLHA NOFA, it represents and certifies that it will use all such funds in a manner consistent and in compliance with all applicable state and federal statutes, rules, regulations, and laws, including without limitation all rules and laws regarding the PLHA Program, as well as any and all contracts City may have with the Department. 5. Finds that this item was noticed in compliance with state and local laws and that the public had an adequate opportunity to review and comment on its content. 6. Certifies that the Plan, attached hereto as Exhibit A, is: in accordance with Section 302(c)(4) of the PLHA Final Guidelines (“Guidelines”), and for a term of five years (2019-2023) and agrees to inform the Department if changes are made to the Plan in each succeeding year of the term of the Plan in accordance with Section 302(c)(5) of the Guidelines. 7. Authorizes and approves the Plan. 8. Certifies that City will ensure compliance with Section 302(c)(6) of the Guidelines if funds are used for the acquisition, construction, or rehabilitation of for-sale housing projects or units within for-sale housing projects. 9. Certifies, if applicable, that that the City will ensure that the PLHA assistance is in the form of a low-interest, deferred loan to the sponsor of the project if funds are used for the development of an Affordable Rental Housing Development. The loan shall be evidenced through a promissory note secured by a deed of trust and a regulatory agreement shall restrict occupancy and rents in accordance with the City’s approved underwriting of the project for a term of at least 55 years in accordance with Section 302(c)(7) of the Guidelines. 10. Certifies that if the City proposes allocation of funds for any eligible activity to another entity, the Local government’s selection process shall avoid conflicts of interest and shall be accessible to the public in accordance with Section 302(c)(3) of the Guidelines. The NOFA process will create a consistent standard for all projects awarded funding. The areas of focus are Application Completeness, Project Design and Capacity, Urgency and Persistence of Need, Project Implementation Readiness, Past Performance, Financial Management, General Regulatory Compliance, Budget, Fund Development, and Leveraging. The City of Petaluma's plan for the utilization of PLHA funding is consistent with the overall goals and objectives of the City's housing element in which the City aims to address and meet the housing needs of all residents within the community. In regards to specific programs outlined in the housing element for which the plan for PLHA funding set forth in this application aligns, the Housing Element identified a goal/program to promote the development of housing affordable to extremely low-, very low-, low- and moderate-income households. The City is seeking PLHA funding solely for the use of predevelopment, development, acquisition, rehabilitation and preservation of mult-family rental housing, the intentions of use of the PLHA funds as financial support for the development of more affordable housing directly aligns with the Housing Element. §301(a)(1) The predevelopment, development, acquisition, rehabilitation, and preservation of multifamily, residential live-work, rental housing that is affordable to extremely low-,very low-, low-, or moderate-income households, including necessary Operating subsidies. §302(c)(4)(E)(i) Provide a detailed and complete description of how allocated funds will be used for each proposed Affordable Rental Housing Activity. §302(c)(4) Plan Rev. 5/14/21 §302(c)(4)(A) Describe the manner in which allocated funds will be used for eligible activities. The City of Petaluma has been slated to receive $1,106,142 for the next five (5) years in Permanent Local Housing Allocation (PHLA) program funding. The City intends to utilize program funding under the direction of eligible activity 301(a)(1) the predevelopment, development, acquisition, rehabilitation, and preservation of multi-family, residential live-work, rental housing that is affordable to extremely low-, very low-, low- or moderate income households, including necessary subsidies. The City of Petaluma proposes to place the PLHA funds in the City’s Affordable Housing Fund for the purpose of developing affordable housing in the City of Petaluma. Affordable housing development projects require multiple sources of funding to compile enough funding to be developed. PLHA grant funds will be leveraged with several other funding sources including Federal and State Low Income Housing Tax Credit (LIHTC) financing and the City's new Local Housing Trust Fund. §302(c)(4)(B) Provide a description of the way the Local government will prioritize investments that increase the supply of housing for households with incomes at or below 60 percent of Area Median Income (AMI). The City of Petaluma will partner with local affordable housing developers by competitively awarding PLHA funds through the issuance of a Notice of Funding Availability (NOFA) through its annual budget process. Through the NOFA process, the City will prioritize projects that increase the supply of housing for households with incomes from 60% to 120% of the AMI. The NOFA will be competitive and scoring of applications for these projects will greatly preference projects with units that are deed-restricted affordable for households with incomes below 60% AMI. Over the last 3 years, the City has provided $5.5 Million in funding to 3 projects providing 227 units affordable to households earning 60% AMI or less. Activities Detail (Activities Detail (Must Make a Selection on Formula Allocation Application worksheet under Eligible Activities, §301)) PLHA funds in this category will be allocated for the predevelopment, development, acquisition, rehabilitation, and preservation of multifamily, residential live-work, rental housing that is affordable to extremely low-, very low-, low-, or moderate-income households. This allocation will be made available to affordable housing developers through a competitive Notice of Funding Availability (NOFA) process. Each NOFA will seek development proposals that include new affordable housing units for households with incomes at or below 120% of AMI with an emphasis on developments that serve individuals at or below 60% AMI. The City works closely with the local affordable housing developers, non-profit partners and the general community to increase affordable housing units across the housing continuum. The City also gives priority to projects that leverage several sources of funding for the maximum benefit to the community. The City has over 30 years of successfully producing, overseeing, and monitoring affordable housing projects that assist individuals and households at or below 120% AMI.
