of the City of Petaluma, California
RESOLUTION ACCEPTING THE COMPLETION OF THE HSIP VARIOUS SAFETY PROJECT –
SIGNAL UPGRADES PROJECT C16101936 TO DC ELECTRIC GROUP, INC.
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162 and other applicable law, City staff prepared construction bid documents and
solicited bids for the HSIP Various Safety Improvement Project – Signal Upgrades (Project); and
WHEREAS, the project was bid on October 8, 2020, and four bids were received and opened on October 27,
2020, in accordance with applicable law; and
WHEREAS, the lowest responsible bid for the Project was submitted by DC Electric Group, Inc. from Cotati
CA, for $296,230; and
WHEREAS, by Resolution No. 2020-170 N.C.S., adopted on December 7, 2020, the City Council found the
bid of $296,230 for the project to be the lowest responsive bid, awarded the Project to DC Electric Group, Inc.,
conditioned on DC Electric Group, Inc., timely execution of the project contract and submitting all required
documents and authorized and directed the City Manager to sign the project contract on behalf of the City; and
WHEREAS, the following contract change orders (CCO) for in-field design alterations and supplemental
flatwork within the project limits affecting the Project amount have been approved:

Total $ 51,850.00
RRFB Project Cost
Change Order #1 $ 13,800.00
Total $ 13,800.00
Grand total $ 65,650.00;
and
WHEREAS, the final contract amount as amended, including all change orders, overruns, and underruns, is
$367,310; and
WHEREAS, City staff have inspected the Project and determined that it has been completed in substantial
accordance with the contract requirements subject to the Contractor’s continuing warranty and other obligations
pursuant to the contract; and
WHEREAS, environmental analysis for compliance with the California Environmental Quality Act (CEQA)
was completed on December 7, 2020, when City Council awarded the contacts for the HSIP various safety
projects and found that the projects were exempt from CEQA pursuant to CEQA Guidelines Section 15301
because the projects consist of the repair, maintenance, and minor alteration of existing public facilities involving
negligible or no expansion of existing or former use, including existing highways and streets, and the addition of
safety or health protection devices for use in conjunction with existing facilities; and

WHEREAS, accepting the completion of the HSIP projects does not constitute a project pursuant to CEQA
Guidelines Section 15378 because the action does not have the potential for resulting in either a direct physical
change in the environment or a reasonably foreseeable indirect physical change in the environment; and
WHEREAS, based on the foregoing, staff recommends acceptance of the project on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby:
1. Declares the above recitals to be true and correct and are incorporated into this resolution as findings of the
City Council.
2. Finds that environmental analysis for compliance with the California Environmental Quality Act (CEQA) was
completed on December 7, 2020, when City Council awarded the contacts for the HSIP various safety
projects. City Council found the HSIP Various Safety Improvement Projects were exempt from CEQA
pursuant to CEQA Guidelines Section 15301 because the projects consist of the repair, maintenance, and
minor alteration of existing public facilities involving negligible or no expansion of existing or former use,
including existing highways and streets, and the addition of safety or health protection devices for use in
conjunction with existing facilities.
Further, accepting the completion of the HSIP projects does not constitute a project pursuant to CEQA
Guidelines Section 15378 because the action does not have the potential for resulting in either a direct physical
change in the environment or a reasonably foreseeable indirect physical change in the environment.
3. Accepts as complete the contract titled HSIP Various Signal Project C16109636, with the final contract
amount of $367,310, subject to the Contractor’s continuing warranty and other obligations pursuant to the
contract.
4. Authorizes and directs the City Clerk to file a Notice of Completion concerning the project with the Sonoma
County Clerk’s Office within ten days of the date of this Resolution.
5. Authorizes and directs staff to release all undisputed retention not subject to pending change order s within
sixty (60) days of the date of this Resolution and in accordance with the terms of the project contract,
California Public Contract Code Section 7107, and applicable law.
6. Authorizes staff to prepare a budget adjustment for the CIP project as outlined in the Financial Impact Section.
Under the power and authority conferred upon this Council by the Charter of said City.

Council of the City of Petaluma at a Regular meeting on the 4th day of October
2021, by the following vote:
