Resolution No. 2021-168 N.C.S.
of the City of Petaluma, California
RESOLUTION ACCEPTING COMPLETION OF THE TENNIS & PICKLEBALL COURT
RENOVATION: RESURFACING UPGRADE FOR COURTS AT LUCCHESI AND MCNEAR PARK
PROJECT BY VINTAGE CONTRACTORS,INC.
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and
WHEREAS, the Project was bid on November 19, 2020, and One (1) bid was received and opened on
December 3, 2020, in accordance with applicable law; and
WHEREAS,the lowest responsible base bid for the Project was submitted by Vintage Contractors,Inc., from
San Francisco, CA for$168,250.00 with a bid alternate#1 of$70,650.00 for a total bid of$238,900.00; and
WHEREAS,by Resolution No 2020-187 N.C.S. adopted December 21, 2020,the City council found the bid
of$168,250.00 for the project to be the lowest responsive bid, awarded the project to Vintage Contractors, Inc.,
conditioned on Vintage Contractors, Inc.'s timely executing the project contract and submitting all required
documents and authorized and directed the City Manager to sign the project agreement on behalf of the City; and
WHEREAS, the following contract change orders for various improvements including additional court
resurfacing and fence repair during construction for the amount below have been approved:
Cost
Change Order#1 $ 46,970.00
Change Order#2 $ 113,000.00
Total Change Orders $ 159,970.00; and
WHEREAS, the final contract amount, as amended, including bid alternate #1, all change orders, overruns,
and underruns, is $398,870.00 and is within the approved project budget; and
WHEREAS,Environmental analysis for compliance with the California Environmental Quality Act(CEQA)
was completed on December 21, 2020, when City Council awarded the contacts for the reconstruction for the
courts. City Council found the Project exempt from CEQA pursuant to CEQA Guidelines Section 15302 because
the projects consist of replacement and reconstruction of existing systems and/or facilities involving negligible or
no expansion of capacity; and
WHEREAS, accepting the completion of the Project does not constitute a project pursuant to CEQA
Guidelines Section 15378 because the action does not have the potential for resulting in either a direct physical
change in the environment or a reasonably foreseeable indirect physical change in the environment; and
WHEREAS,the FY 21/22 CIP budget is sufficient to complete the project as bid.
NOW, THEREFORE,BE IT RESOLVED that the City Council of the City of Petaluma hereby:
1. Declares that above recitals are to be true and correct and are incorporated into this resolution as findings of
the City Council.

2. Finds that the Environmental analysis for compliance with the California Environmental Quality Act(CEQA)
was completed on December 21, 2020,when City Council awarded the contacts for the reconstruction for the
courts. City Council found the Project exempt from CEQA pursuant to CEQA Guidelines Section 15302
because the projects consist of replacement and reconstruction of existing systems and/or facilities involving
negligible or no expansion of capacity.
Further, accepting the completion of the Project does not constitute a project pursuant to CEQA Guidelines
Section 15378 because the action does not have the potential for resulting in either a direct physical change
in the environment or a reasonably foreseeable indirect physical change in the environment.
3. Accepts as complete the contract titled Tennis & Pickleball Court Renovation: Resurfacing Upgrade for
Courts at Lucchesi and McNear Park Project, Project No. C14502011, with the final contract amount of
$398,870.00, subject to the Contractors continuing warranty and other obligations pursuant to the contract.
4. Authorizes and directs the City Clerk to file a Notice of Completion concerning the project with the Sonoma
County Clerk's office within ten(10) days of the date of this Resolution.
5. Authorizes and directs Staff to release all undisputed retention not subject to pending change orders within
sixty (60) days of the date of this Resolution and in accordance with the terms of the project contract,
California Public Contract Code Section 7107, and applicable law.
Under the power and authority conferred upon this Council by the Charter of said City.
