HomeMy WebLinkAboutResolution 2021-175 N.C.S. 11/01/2021 DocuSign Envelope ID:4007DB50-B444-42CB-84F1-DD378C55AED7 Resolution No. 2022-175 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING THE PETALUMA POLICE DEPARTMENT TO PROCURE PORTABLE AND MOBILE POLICE RADIOS IN THE AMOUNT OF $417,236 TO REPLACE RADIO EQUIPMENT NO LONGER SUPPORTED BY THE EMERGENCY COMMUNICATION RADIO SYSTEM AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL PROJECT AND EQUIPMENT RELATED DOCUMENTS. WHEREAS, the City has identified a need to replace all antiquated Motorola police portable (person) and mobile (vehicle) radios; and WHEREAS, the City acknowledges the changes in California law regarding radio encryption and interoperability necessitates the timely upgrade and replacement of our portable and mobile radios; and WHEREAS,the City has determined Harris-Dailey-Wells is the vendor already providing the encrypted and interoperable digital radios that meet the needs of the Department and existing law; and WHEREAS, the City has already purchased Harris-Dailey-Wells portable radios and vehicle radios and been trained to use Harris-Dailey-Wells equipment; and WHEREAS, for officer and public safety it is necessary to purchase the remaining portable and mobile radios with Harris-Dailey-Wells equipment for interoperability; and WHEREAS,the purchase of these radios is contingent and part of a large scale multi-phase Emergency Radio Communications Upgrade Project; and WHEREAS,this interoperability technology will provide communication capabilities with all regional public safety agencies; and WHEREAS, the City has already approved the purchase amount as part of the Adopted Fiscal Year 2022 budget; and WHEREAS,the Police Department complied with the purchasing requirements of the Petaluma Charter and Petaluma Municipal Code; and WHEREAS, the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, as authorizing the purchase of a police radio equipment to replace existing equipment does not meet CEQA's definition of a"project,"because the action does not have the potential for resulting either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment,and even if the proposed action did constitute a project under CEQA, this action is exempt under the common-sense exemption, CEQA Guidelines Section 15061(b)(3)because it can be seen with certainty that there is no possibility that the proposed action could have a significant impact on the environment. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Declares the above recitals to be true and correct and are incorporated into this resolution as findings of the City Council. Resolution No. 2021-175 N.C.S. Finds the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, as authorizing the purchase of police radio equipment to replace existing radio equipment does not meet CEQA's definition of a "project," because the action does not have the potential for resulting either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. Alternatively, if the proposed action did constitute a project under CEQA, this action is exempt under the common-sense exemption, CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility that the proposed action could have a significant impact on the environment. 3. Approves the purchase of Harris-Dailey-Wells portable and mobile radio equipment in the Amount of $417,236. 4. Authorizes the City Manager, or her designee, to execute any necessary agreements and documents to complete the purchase of the equipment. Under the power and authority conferred upon this Council by the Charter of said City.
