2 RESOLUTION ADOPTING A MITIGATED NEGATIVE DECLARATION
3 PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)
4 FOR REZONING OF A 14 ACRE PORTION OF ASSESSORS PARCEL
5 NO. 137-070-24 FROM A TO PUD, APPROVAL OF THE UNIT DEVELOPMENT
6 PLAN, AND TENTATIVE SUBDIVISION MAP FORA 100 UNIT SINGLE FAMILY
7 RESIDENTIAL DEVELOPMENT COMPRISING 15.22 ACRES
8 TO BE KNOWN AS AMERICANA

10 WHEREAS, the Planning Commission at its public hearing of December 14, 1993,
11 considered and recommended adoption of a Mitigated Negative Declaration. pursuant to
12 the California Environmental Quality Act (CEQA) in conjunction with the following
13 actions:

15 1. Rezoning of a portion of AP No. 137-070-24 from A (Agriculture) to PUD (Planned
16 Unit Development);
17
18 2. Conditional approval of the PUD Unit Development Plan and Development
19 Standards filed with the Planning Department on October 6, 1993;
20
21 3. Conditional approval of the Tentative Subdivision Map for the creation of 100
22 single family lots and a remainder parcel, filed with the Planning Department on
23 October 6, 1993;

25 NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council hereby finds as
26 follows:

28 Findings for Mitigated Negative Declaration:
29 1. An Initial Study has been prepared and proper notice provided in accordance with
30 CEQA and local guidelines:

32 Based upon the Initial Study and comments received, potential impacts could be
33 avoided or reduced to a level. of insignificance by mitigation measures attached as
34 conditions of approval. There is no substantial evidence that the project, as
35 conditioned, would have a significant effect on the environment.

37 2. A monitoring program has been included to ensure compliance with the adopted
38 mitigation measures, if any.

1 3. The project does not have potential to affect wildlife resources as defined in the
2 Fish and Game code, either individually or cumulatively and is exempt from Fish
3 and Game filing fees.

5 BE IT FURTHER RESOLVED that the Petaluma City Council, in reference to the
6 potential impacts identified in the Initial Study, hereby adopts the Mitigated Negative
7 Declaration including the following mitigations to be attached as conditions of approval for
8 the Americana Subdivision project, as recommended by the Planning Commission:

10 Mitigation Measures
11 1. To ensure adequate secondary access to the project site, Sandstone Drive and the
12 Reisling Road extension to the northeasterly edge of the Americana Subdivision
13 shall be constructed prior to occupancy of the first unit constructed for the
14 subdivision.

16 2. The alignment of the extension of Reisling Road to Sonoma Mountain Parkway
17 shall be determined in conjunction with future development proposals for the
18 remaining Gatti property.

20 3. The existing driveway easement and access road serving the 5 county residents east
21 of the Urban Separator shall be replaced with vehicular access along Reisling Road
22 and Sandstone Drive. Continuous access shall be reasonably maintained throughout
23 construction of the project, and plans for temporary relocation of the driveway
24 during construction of the permanent roadway shall be subject to staff review and
25 approval prior to approval of the Final Map. Evidence of agreement between the
26 affected parties regarding the interim relocation of the private driveway shall be
27 submitted at time of Final Map application or abandonment of the Old Ely Road
28 right of way, whichever occurs first.

30 4. A written notice shall be recorded with the Final Map for this project which advises
31 future property owners of the existence of nearby agricultural uses and the
32 possibility of traffic, noise, odor and other impacts. In addition, a similar notice
33 shall be provided via certified letter to all property owners and residents situated
34 along Sandstone Drive within the Graystone Creek subdivision at time of Final Map
35 application.

5. All homes backing onto Sonoma Mountain Parkway and Ely Road shall meet
General Plan provisions for acceptable interior noise levels adjacent to arterials. A
noise study shall be conducted prior to building permit application which specifies
the projected noise levels based on buildout of the Corona/Ely area, and
recommendations for noise mitigation if necessary to bring the properties into
compliance. Project proponents shall be responsible for costs of the study, and
selection of consultant shall be to staff approval. A written notice shall be recorded
with the Final Map which advises future property owners of potential noise impacts.
Notice shall be to Planning staff approval prior to Council's approval of the Final
Map.

6. This project shall comply with all applicable mitigations specified for properties
within the Corona/Ely Specific Plan Area as contained in Resolution No. 89-122
which certified, approved and adopted the Environmental Impact Report for the
Corona/Ely Specific Plan.
