Resolution No. 2021-192 N.C.S.
of the City of Petaluma, California
RESOLUTION AUTHORIZING THE AWARD OF CONTRACT FOR THE PETALUMA
BOULEVARD SOUTH ROAD DIET PROJECT C16101601 TO AZUL WORKS, INC.
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162 and other applicable law, City staff prepared construction bid documents
and solicited bids for Petaluma Boulevard South Road Diet Project C19101601 (Project); and
WHEREAS, the project was bid on October 1, 2021, and six (6) bids were received and opened on
October 28, 2021, in accordance with applicable law; and
WHEREAS, the lowest responsible bid for the Project was submitted by Azul Works, Inc. from San
Francisco CA, for $2,956,981.70; and
WHEREAS, the lowest responsible bid alternates for the Project were also submitted by Azul Works,
Inc. for $273,268.00; and
WHEREAS, Azul Works satisfies the bidding requirements for the Project; and
WHEREAS, Azul Works possesses a valid California Contractor’s License, Class A #780074, that
covers the work; and
WHEREAS, the time to protest the lowest responsible bidder has lapsed; and
WHEREAS, it has been determined by Caltrans that the Petaluma Boulevard South Road Diet Project
has no significant impacts on the environment as defined by NEPA; as such, Caltrans has determined the
project is categorically excluded from the requirements to prepare an EA or EIS under NEPA; and
WHEREAS, the Petaluma Boulevard South Road Diet Project is categorically exempt pursuant to
California Environmental Quality Act (“CEQA”) and Title 14, the California Code of Regulations
(“CEQA Guidelines”), Section 15301, because the project consists of repair and maintenance to an
existing public street, sidewalks and curbs; and
WHEREAS, Bid alternates 1 and 2, sidewalk gap closure and traffic single conduit for Caulfield
Bridge is categorically exempt pursuant to CEQA Guidelines Section 15303, as they are each minor
construction of existing facilities.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby:
1. Declares that the above recitals are true and correct and are incorporated into the resolution as
findings of the Petaluma City Council. 2. Finds that this project is categorically exempt from California Environmental Quality Act (“CEQA”) requirements pursuant to Article 19, Section 15301(c), of Title 14 of the California Code of Regulations (“CEQA Guidelines”), because the project consists of the repair, maintenance, and minor alteration of existing public facilities involving negligible or no
expansion of existing or former use. This project will rehabilitate the existing roadway incorporating bicycle, pedestrian, and transit improvements, the installation of ADA curb ramps, curb bulb-outs, sidewalk and driveway reconstruction, installation of rectangular rapid flashing beacons (RRFB) at uncontrolled crosswalks, signal upgrades and modifications, and new pavement overlay and pavement striping. Bid alternates 1 and 2, sidewalk gap closure
and traffic single conduit for Caulfield Bridge is categorically exempt pursuant to CEQA Guidelines Section 15303, as they are each minor construction of existing facilities. Accordingly, there is negligible or no expansion of use beyond what currently exists and there are no cumulative impacts, unusual circumstances, or other factors that would make the exemption inapplicable pursuant to CEQA Guidelines section 15300.2.
3. Approves the revised project budget of $3,795,291.00 for the for the Petaluma Boulevard South Road Diet Project C19101601. 4. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162, and other applicable law, waives any and all non-conformance in the bid of Azul Works, Inc. for the Petaluma Boulevard South Road Diet Project C16101601
and finds the bid of $3,230,249.70 to be the lowest, responsive bid and further finds that Azul Works Inc., is the lowest responsible bidder. 5. Awards the contract for the Petaluma Boulevard South Road Diet Project C16101601 to Azul Works, Inc. in the amount of $3,230,249.70, the amount of the lowest responsive bid, conditioned on Azul Works’ timely executing the project contract, and submitting all required
documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 6. Directs staff to issue a notice of award to Azul Works, Inc. 7. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by Azul Works, Inc. of the signed project contract and all
other required document, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 8. Approves a construction contract contingency of $250,000 for Petaluma Boulevard South Road Diet Project C19101601. 9. Authorizes staff to prepare a year-end budget adjustment for the CIP project as outlined in the
Financial Impact Section.

REFERENCE: I hereby certify the foregoing Resolution was introduced and adopted by
the Council of the City of Petaluma at a Regular meeting on the 6th day
