3 GRANTING 1995 ALLOCATIONS

5 WHEREAS, the City Council has adopted a growth management system by Ordinance
6 1716 N.C.S. (Chapter 17.26 of the Petaluma Municipal Code) establishing the procedure
7 for granting the allocation pool on a yearly basis; and

9 WHEREAS, interested developers have filed Notice of Intent to Develop forms in
10 accordance with the provisions of Chapter 17.26 and these, in combination with other
11 allocation obligations created and anticipated by the action of the City Council, comprise
12 the total number of allocation requests for 1995; and
13
14 WHEREAS, the total number of requested and/or obligated allocations for 1995 equals
15 250 units; and
16
17 WHEREAS, the 1995 allocation pool was set at 258 units; and
18
19 WHEREAS, the City Council finds the granting of allocations is not a project pursuant to
20 Section 1578 of the California Environmental Quality Act and, therefore, no environmental
21 action is necessary at this time.

23 NOW, THEREFORE, BE IT RESOLVED that the City Council grants the 1995
24 allocations as described below based on findings described below:

15 BE IT FURTHER RESOLVED that the City Council makes the following findings in
16 .support of its granting the 1995 allocations:

18 Findings:
19 1. The number of 1994 allotments is consistent with the provisions of the Residential
20 Growth Management System Ordinance (Chapter 17.26 of the Petaluma Municipal
21 Code) and the applicable policies of the 1987-2005 Petaluma General Plan.

23 2. The decision to grant 1995 allocations as specified herein is not detrimental to the
24 public health, safety or welfare because the City Council has considered the
25 applications for 1995 allocations in the context of overall City-wide growth rates,
26 adequacy of public facilities, and subsequent environmental review procedures.

28 3. The granting of forty-five (45) 1995 allocations to in-fill projects is consistent with
29 the Residential Growth Management System Ordinance, Section 17.26-060(c)
30 Award of Allotments.

32 4. The City Council grants sixty-seven (67) allocations to Corona/Ely assessment
33 district properties pursuant to their collective development agreements.

The secondary pool for special projects, which will assist the City in meeting its
General Plan goals for achieving a variety of housing types, has sufficient allocations
for any project needs in the near future.
There was no compelling reason to deny allocations to any of the projects.
